The same resolution instructs the Foundation to conclude an agreement on the joint use of the Temple premises with the Compound of the Patriarch of Moscow and All Rus' (a religious organization).
As follows from the agreement on the joint use of premises dated 01.02.2006, concluded between the Foundation of the Cathedral of Christ the Savior and the Compound of the Patriarch of Moscow and All Rus', a total of 78 rooms with a total area of 3697.27 square meters were transferred to the use of the Compound. meters, that is, less than 7% of the total area of the temple.
Among them: accounting offices, a server room, bathrooms, a groom's room, a refectory, a washroom, a shower room, a Book Shop store and an Icon Shop store, utility rooms, storage rooms and other rooms.
The premises of the Upper Church, where the punk band Pussy Riot performed on February 21, 2012, never belonged to the Compound of the Patriarch of Moscow and All Rus' (the church itself). Religious ceremonies held in these premises were carried out illegally.
This circumstance is also confirmed by an extract from the unified state register of rights to real estate and transactions with it No. 05/017/2012-576 dated June 18, 2012, according to which the premises of the Upper Church are owned by the city of Moscow and in trust management of the FHHS (secular NPO).
There are no restrictions or encumbrances on the right to the premises of the Upper Church registered by the Moscow Office of Rosreestr.
Thus, the musical group Pussy Riot performed their hit “Mother of God, drive Putin away” in a public place in a building owned by the city of Moscow.
The religious organization Compound of the Patriarch of Moscow and All Rus' does not have legally established rights to conduct religious ceremonies or use this premises for its own purposes.
In addition, on the day of the Pussy Riot performance, no church services were held in this room; it was open to all visitors, including tourists, like many other public places in Moscow: museums, exhibitions, vernissages.
It is obvious that citizens of the Russian Federation, taxpayers, whose money supports a municipal property - the recreated architectural monument of the Cathedral of Christ the Savior, have the right to visit the canteen, dry cleaners, car washes, car services, offices of commercial firms, shopping and other facilities located in the building of this business center .
The legislation of the Russian Federation does not prohibit the performance of songs in public places. The ban, based on the rules and traditions of the Orthodox Church, cannot apply to objects not under the jurisdiction of the Russian Orthodox Church MP.
Based on the provisions of Art. 14 of the Constitution of the Russian Federation, the Russian Federation is a secular state, and therefore no religious organization has the right to establish its own rules of conduct in premises that do not belong to it, which are public places, or to introduce any restrictions or prohibitions for visitors.
Moreover, these actions of the Religious organization Compound of the Patriarch of Moscow and All Rus' to establish its own order of behavior, introduce prohibitions and restrictions in a public place based on the rules of the Trullo and Laocidian church councils (VII and IV centuries AD), should be qualified as arbitrariness ( Art. 330 of the Criminal Code of the Russian Federation).
The Society for the Protection of Consumer Rights filed an application with the Moscow City Prosecutor's Office demanding that officials of the Compound of the Patriarch of Moscow and All Rus' be held criminally liable for committing arbitrariness in the unauthorized disposal of premises belonging to the city of Moscow.
The lawyers of the defendants in the Pussy Riot case were sent documents on the ownership of the premises of the Upper Church of the multifunctional business center Cathedral of Christ the Savior.
