Bailiffs were unable to forcibly bring nine witnesses to testify in the criminal case against sambo wrestler Rasul Mirzaev, who is accused of delivering a fatal blow to student Ivan Agafonov, an Interfax correspondent reported.
Judge Andrei Fedin, at a meeting on Monday, received protocols from the bailiff service about the impossibility of delivering witnesses for various reasons. In this regard, the judge decided to listen to the testimony of witnesses given at the preliminary investigation stage. In particular, Agafonov’s friends, interrogated by investigators, note in their testimony that they did not see the incident itself that evening, but learned about it from third parties. They also all noted that Ivan Agafonov was “tipsy” that evening.
World champion in combat sambo Rasul Mirzaev is accused of intentionally causing harm to health, resulting in the death of the victim (Article 111 of the Criminal Code). According to the investigation, on August 13, 2011, near the Moscow club "Garage", Mirzaev hit 19-year-old student Ivan Agafonov during a conflict. As a result of the impact, Agafonov fell and hit his head on the curb. A few days later, Agafonov died.
