The Tver court of Moscow recovered 450 thousand rubles from the Ministry of Finance in favor of the retired Colonel of the GRU Vladimir Kvachkov, RIA Novosti reports. Judge Evgeny Komissarov partially satisfied his claim for compensation for moral harm for the illegal persecution of the assassination of the former head of the RAO UES of Russia Anatoly Chubais. In 2010, Kvachkov was justified in this case.
Kvachkov estimated the causal harm to him at 50 million rubles. The Ministry of Finance refused to recognize the lawsuit. After the court’s decision was announced, the representative of Kvachkov Oksana Mikhalkina stated that they would have to appeal him without fail.
On Friday, representatives of the retired colonel stated in court that the courts extended the deadline for his detention 14 times, acting unreasonably and thereby causing him moral damage. According to lawyers, numerous publications in the media of an offensive nature also brought moral suffering to the client. “In addition, Vladimir Vasilievich was caused by false information about the detention of his son, which the FSB officer told him to provide him with pressure,” Mikhalkina said. She added that to prove this information, Kovachkov presented a falsified note from the newspaper about this. In addition, according to the lawyer, Kvachkov did not allow Kvachkov for a long time to meet his wife.
In turn, the defendant considered that the amount of non -pecuniary damage declared by Kvachkov was significantly overstated.
On December 22, 2010, the Supreme Court recognized the as a legal sentence to Kovachkov and other defendants in the attempt in 2005. However, the very next day, the Lefortovo court of Moscow authorized the arrest of a retired colonel in the new case. It was excited on the day of the detention of Kvachkov and has a “secret” vulture.
The investigation was charged to Kvachkov under part 1 of Article 205.1 of the Criminal Code (promoting terrorist activities) and in part 3 of Article 30 of the Criminal Code of the Russian Federation, Article 279 of the Criminal Code (attempt on armed rebellion). The most strict punishment in one of the articles is 20 years in prison.
Kvachkov does not admit guilt. His defense believes that the charges are unfounded, and there are no facts in the case file. According to Kvachkov himself, the essence of the charges against him is the preparation for the overthrow of the power of the armed groups from among the Togliatti members of the organization “People’s Front of the Liberation of Russia” headed by him.
The investigation came to the preliminary conclusion that Kvachkov organized in a number of cities of the Group of Militias, which were supposed to capture military units by signal and go on an armed campaign to Moscow. The testimony, on the basis of which Kvachkov was arrested, gave Peter Galkin, the leader of the Togliatti branch of the "People's Militia named after Minin and Pozharsky." According to him, the departments of the "people's militia" headed by Kvachov were created in order to capture and disarm military warehouses at a certain moment. Moreover, it was assumed that the military would go over to the side of the militias. For what purpose the armed groups had to move to Moscow, Galkin did not report.
In May, the six years of imprisonment, Vladislav Ladeshchikov, found guilty of the assistance of terrorism, was conditionally sentenced. He also entered the "People's Militia named after Minin and Pozharsky." Ladeshchikov testified to other conspiracy participants, which can be used against Kvachkov.
