America is the best refuge from Russian legal chaos. But is it possible to build a new business in the USA?

Yuri Mosha remembers the five-hour car race on the icy Moscow-Minsk highway as a bad dream. Just like that whole day, March 9, 2011, when he was supposed to be arrested. He only came to his senses on the Minsk-Vienna plane. Realizing that the worst was over, Mosha drank a glass of cognac in one gulp. Another half a day - and he already stepped out onto the wet surface of John F. Kennedy Airport in New York and, not paying attention to the rain, raised his eyes to the sky: “Freedom!”

Mosha, a savvy entrepreneur from the Krasnodar region, tells the story of his escape from Russia while sitting in the kitchen of a small apartment in Brooklyn. Dinner - shrimp - is heating up on the gas stove. Now the case of the owner and general director of the Kuban Investment Fund company, Yuri Mosha, has collapsed and is closed, and then he was on the verge of arrest.

In New York, Mosha lives a completely different life. He organized the website Pokanepozdno.com, through which he helps entrepreneurs persecuted in Russia to go abroad. According to Moshi, out of 30 people who move per month, one way or another using the consulting assistance of his company, three are entrepreneurs who have already had a criminal case filed against them, or those who have been threatened by the security forces.

In his online address, he says that he absolutely does not want to be known as an assistant to fugitive swindlers. It’s just that the number of criminal cases brought against entrepreneurs in Russia has long exceeded all reasonable proportions. At the moment, about 300,000 entrepreneurs are in prison, according to Business Russia, 3 million criminal cases are initiated annually on economic charges, and cases are often ordered by competitors. Moshi's story seems to be becoming typical for Russia.

“was friends with the authorities...”

Yuri Mosha always managed to get along well with the authorities. For some time he was even an official himself. One day, he, the owner of a prominent advertising company at the local level, was invited by the mayor of Novorossiysk, Vladimir Sinyagovsky. It was necessary to adequately represent the region at the Sochi forum: “Design stands, books, so that everything would be beautiful, pretentious, so that Putin would come up to the stand and be stunned,” recalls Mayor Mosha’s wish. To achieve this, the entrepreneur became the head of the city’s investment department for five months.

While working in the civil service, Mosha decided to radically change the direction of his activity and engage in development. The entrepreneur found a hole in the law: if the house is no more than 1500 sq. m, then this is an individual housing development - you can build it and then sell the apartments as shares. The result is serious savings. “You pay a bribe of $100,000 just for a construction permit, and you’ve already saved a hundred,” Mosha reveals the secrets of his business. Mosha saved the same amount on the commissioning certificate, plus another $100,000 on certificates from firefighters, SES and other officials. That's $300,000 in savings for one house of no more than 1,500 square meters. m. In addition to saving at least $200 per 1 sq. m, Mosha increased the speed of construction, which is usually greatly hampered by bureaucratic obstacles.

Mosha admits that he regularly paid bribes in order to be friends with the authorities. “I was an element of this corrupt system, I admit it. I took it to the Federal Registration Service and the BTI so that they could register faster. The judges were given... All this was always paid to everyone, without this you can’t do business at all,” the entrepreneur throws up his hands. According to Moshi, he was close to power and was not afraid of anything. Experience in administration immediately opened many doors. “I could go to the police chief’s office without any problems, and to the deputies of the mayor too. “We both had mobile phones, and any questions we had, they came and solved them.”

The Kuban Investment Fund company entered the market, boldly dumping. A square meter of housing was sold for 30,000 rubles, while the market offered from 40,000 to 60,000 rubles. Apartments in new buildings were sold out without delay. Market participants did not expect such a fast competitor. “It just started to piss them off. Those companies that paid bribes and built traditionally began to tell the mayor: he got us, destroy him, crush him. And from a friend of the government, I became its enemy” - this is how Mosha explains everything that happened to him next.

At the beginning of 2010, the mayor's office filed a lawsuit in the Primorsky District Court, demanding the demolition of houses built by the Moshi company due to violation of construction and fire safety standards. The court seized the houses as an interim measure. Then the bailiffs appeared on the scene: the deputy head of the local department of the FSSP, Sergei Nigoev, promised one of Mosha’s assistants, Oleg Podgorny, that the businessman would soon have problems - the houses would have to be demolished. The bailiff promised to solve them for a modest reward of 20 million. “At that time I only had 10 houses, which means 2 million per house,” Mosha calculates. He was not ready to provide this amount in a week, especially since he was not sure that the amount of the bribe would not be subsequently increased.

Therefore, Podgorny went to the next meeting with a voice recorder. Mosha found protection from the Krasnodar Regional Department of Economic Crimes and the FSB, and the very next day, in the strictest secrecy, guests from Krasnodar carried out a special operation. Several cars surrounded the local bailiff's office, having previously twisted their license plates and placed "checkers" on the roof. Representative Moshi was bought a black shirt, into which the OBEP officers screwed a camera and sent it to Sergei Nigoev. The official was arrested after his assistant was given a bribe of half a million rubles.

Later, not wanting to get involved with hundreds of shareholders, the mayor’s office entered into a settlement agreement with the Moshi Foundation, according to which it undertook to correct the violations. But by that time the businessman already had more serious problems.

Just three months later, the case against Nigoev was closed, and the bailiff returned to his duties and, according to Moshi, began to take revenge. The entrepreneur became a defendant in a criminal case regarding the construction of a fence on the territory of a parking lot rented from the Novorossiysk mayor's office. After registering the rights to the building, Mosha turned to the city authorities with a request to buy the site, but he was refused. And the Novorossiysk Department of Internal Affairs opened a case against him under Article 159 for attempted theft of a plot.

To “resolve issues,” Mosha flew to Moscow almost every day for meetings with officials. Some took money for organizing meetings with higher-ranking officials, and they took them with apartments and let them go, promising to solve something. One even promised to lobby and arrange the appointment of Mosha as mayor of Novorossiysk, the other promised good contracts for the construction of cottages on FSB lands. But, despite the fact that Mosha gave away 12 apartments for bribes, the matter was moving towards a natural conclusion. On March 5, Mosha learned that a warrant had been signed for his arrest and decided to flee the country.

Honorable work

Nikita Kirsanov, another newly minted emigrant who moved to America from Orel in June of this year, can tell a similar story. Today he is an ordinary advertising manager in a Russian-language company, rents a room in Brooklyn and is waiting to receive political refugee status. Taking with him the last $10,000, Nikita fled from Russia, where he was sentenced to 3 years in prison for quarreling with local security forces.

The entrepreneur first ran DVD stalls, and in 2008 bought the pavilion. At the same time, OBEP officers came to him with a pre-prepared complaint about the sale of counterfeit products, seized all the goods for inspection and offered to cooperate - to share the profits, $1,000 a month. Since Kirsanov earned about $3,000 in profit with a turnover of $10,000 per month, he did not agree. “I was one of the few who sell only licensed goods,” says Kirsanov. - Why should I pay?

The goods were never returned to him, having been confiscated, the contracts and documents did not help at the trial, the regulators conducted their own examination, which showed that the goods were counterfeit. When he purchased new goods, that too was confiscated. Complaints about corruption did not help, but Kirsanov managed to get an appointment with the head of the Internal Affairs Directorate of the Oryol Region, Yuri Savenkov, who just then replaced the current Minister of Internal Affairs, Vladimir Kolokoltsev. “This can’t happen. Regarding the disks: don’t work, and there won’t be any problems,” Savenkov explained to him. - “Where should we go to work?” - “There is an honorable job. It's called a janitor."

According to Kirsanov, at first they wanted to force him to cooperate, but when he began to publicly talk about the actions of the security forces, the task changed. In total, eight criminal cases were opened against Kirsanov’s relatives, who according to the papers were the owners of his companies. In the spring, investigators managed to take evidence that the owner was Kirsanov. The cases of counterfeit goods were combined, adding up the amount of damage, and a case was opened against the entrepreneur personally, after which Kirsanov had to flee to the United States.

Russian wave

There are hundreds of fugitive entrepreneurs like Mosha and Kirsanov in America today. Nobody keeps records of them. But indirect evidence suggests that the United States is experiencing an influx of Russians. In the largest area of New York - Brooklyn - buyers from Russia began to purchase 15% more real estate compared to last year, states Albert Wilk, owner of one of the largest real estate companies in Brooklyn. According to him, even more often houses are rented.

Lawyer Edward Mermelstein, who specializes in working with respectable Russian clients, says that since December 2011, the number of “green cards” (residence permits) that Russians receive under the Investor program has increased significantly. The US government's EB-5 program provides immediate receipt of a green card for investments of $500,000 in the US economy. According to the lawyer, if earlier he registered from two to three transactions per month under the program, now it is 7-8 times more. It turns out that Russians leave up to $12 million a month in the United States through his law office alone. The total number of such transactions in New York alone, according to the lawyer, is an order of magnitude greater.

But this method of obtaining a residence permit is considered quite risky in the United States. By transferring money to a company that, for example, constructs a building, an EB-5 participant receives his money back within 2-5 years. But if in two years the company does not create the volume of jobs required by the state, the green card may be taken away. To guarantee results, it is necessary to control the investment process, and most Russians invest just in case, visiting the country on short visits. But this does not stop the Russians - so many companies have appeared on the market that Mermelstein is not sure that there will be workers for everyone. “It’s hard to know which of these companies has owners who can deliver on their promises,” the lawyer complains. - There are a lot of them".

There is another way. Those wishing to enter the United States must obtain an L-1 entrepreneur visa, for which they need to register a branch of the company in the United States and rent premises there. “The visa is essentially an immigration visa; after a few months it can be exchanged for a green card,” Mosha explains in his video blog “Russian America,” which he started to promote emigration among Russian entrepreneurs. Since Mosha just started, so far only three out of 30 applications per month are actually from entrepreneurs. But it should be borne in mind that this is a visa, not a residence permit - this stops many who want to emigrate.

It is significant that Mosha himself, however, applied for political refugee status. According to him, this is also not difficult to do, the main thing is to collect evidence. The condition for granting this status is the risk of persecution in the homeland due to religious, political and other views. For Moshe, a description of his criminal case with details was enough for a green card.

Start life again

Obtaining legal status is not the main problem for Russian Americans. It is much more difficult to find a use for yourself in your new homeland. Mosha was leaving Russia, where he had a large villa on the seashore with a swimming pool, sauna, cinema and a security staff of 6 people. He came to New York alone - his wife categorically refused to leave Russia. All 53 constructed objects were arrested as collateral in the case of the theft of a parking lot. “When I arrived, I was under terrible stress. “I cried,” says Mosha. “Then I started drinking, although I have a very tough character. Even my employees didn’t like me because I fired easily and made tough decisions easily.” But he decided to look at life from the other side: “I was lucky. I’m free - and God bless him and the business, let them live in these apartments.”

The entrepreneur decided to remember his first profession and went to work as an advertising director at a local emigrant radio station. “I have a higher economic education, knowledge, and many years of successful business experience, and I can bring benefit to your company. I’m not afraid of any work, I’m ready to work up to 12 hours a day, to strictly carry out orders and tasks set by management” - such a desperate resume was sent by a man who recently had a fortune of $20 million. At the radio station he met the entire emigrant establishment, became a partner of lawyer Arkady Bukha and is responsible for immigrant clients from Russia.

Business Pioneer

The career of Alexander Konanykhin is one of the few stories of relative success after the rise and crash in Russia. One of the first bankers in Russia, the owner of the All-Russian Exchange Bank was for some time a competitor of Mikhail Khodorkovsky and his Menatep bank. “Khodorkovsky moved very quickly, we were neck and neck. It was an intellectual competition, like a game of chess,” the entrepreneur recalls those times. However, long-standing strong ties with former KGB officers did Konanykhin a disservice. As the businessman says, in 1992 he was taken hostage in Budapest by his own guards - former law enforcement officers.

Now Konanykhin tells how in 1992 he advised Khodorkovsky to quit Russian business. “I told Mikhail: take action, the situation is changing quite quickly. Look, if you delay, you could be next,” recalls the fugitive entrepreneur. He was wrong with his forecast by a dozen years: Khodorkovsky’s business was then only growing stronger, and soon he hired Konanykhin for a job - to be responsible for the international development of the bank. With the help of the Menatepovites, Konanykhin then managed to cope with the attack by the security forces. He headed the subsidiary of Menatep - European Union Bank. However, the showdown with the security forces did not end there. In 1994, the military prosecutor's office in Russia opened a case against him for embezzling $8.1 million from his bank. In 1996, Konanykhin was arrested in the United States by the Federal Immigration Service on a tip from Russia and spent a year behind bars for violating immigration laws. But as a result, Konanykhin was first released from prison without bail, and then all charges against him were completely dropped, giving him the status of a political refugee. In 2004, the case in Russia was closed as unlawfully initiated.

However, Konanykhin is in no hurry to return home. While holed up in the States, he organized a small company, KMGI. Its current turnover is $5 million, the company sells software with which you can track the actions of each employee, even checking what was on his computer screen during working hours. Another division of the company deals with new advertising technologies on the Internet. Despite the fact that the main revenue comes from the United States, Konanykhin is not a tax resident of America. His companies are registered offshore, and only one operates in the United States - for those clients who definitely need an American resident for settlements. He himself travels to different countries - besides the USA, he has a residence permit in England, Italy, Spain and Argentina.

Rare luck

Classic success stories are extremely rare among Russians in the USA. The story of political emigrant Pavel Zabelin, co-owner of the Moscow Youth Palace, began in 2004, after he refused to testify against Leonid Nevzlin, one of the co-owners of the Menatep group. According to Zabelin, the prosecutor's office charged him with fraud. Zabelin's case was considered by judge Marina Syrova, the same one whose finest hour came during the trial of the Pussy Riots. Zabelin says that, watching the girls in the Khamovnichesky court, he often experiences a feeling of déjà vu. During his case, the judge refused to grant defense requests to request payment documents and question all defense witnesses without exception.

He learned about the searches at his home while on a trip to Estonia. There he remained, asking for political asylum. Then, having received a visa, he moved to the USA. Now Zabelin lives in Europe, and when asked what business he is involved in, he answers that “intellectual property protection and alternative energy.” According to him, he creates new technologies that make it possible to save a lot. Zabelin does not disclose details, claiming that these are personal developments, the technical details of which can be adopted by competitors. His business has not even entered the startup stage.

Someday Zabelin hopes to return to Russia: “I am a doctor of science, and my economic calculations suggest that the breakdown of the Russian system will happen much earlier than everyone expects, taking into account how oil and gas consumption is declining and how alternative energy is developing.” .

Lawyer Pavel Ivlev, who started his business and legal career in the early 1990s with current Deputy Prime Minister Igor Shuvalov, left for the United States after a tough conversation with the investigator in the Khodorkovsky case. According to him, most large businessmen who left Russia have great difficulty finding themselves in the United States. “The American market is very competitive, tough and developed, unlike Russia. It’s difficult for a person with a Russian background; the business environment in America is simply at a different stage of development. The Russian experience does not help people at all, but rather hinders them. I saw people who try to play by their own rules, and what comes out of it,” states Ivlev.

Dan Rappoport, who left Riga for the United States with his parents at age 11 but subsequently worked for many years in the investment business in Russia (he is also co-owner of the Soho Rooms restaurant), admits that Russian skills are difficult to transfer to America. Even his experience of working in a corrupt, strange system is rather harmful - having returned to America, he plans to concentrate on charitable projects.

Unlike young people who stayed in America after receiving an MBA, established entrepreneurs over 40 who left Russia often cannot fit into the American environment. “Russians get more pleasure from spending the money they have. This is normal, they were oppressed for a long time by the Soviet system,” says Rappoport. “They are compared to rich African-Americans who immediately hang themselves in gold and ride in limousines. I understand perfectly well, I’m like that myself after 21 years of living in Russia. And everyone looks at me in surprise.” According to him, the attitude of Americans towards Russians depends on the level of education and erudition. “The most educated people think of Russia not as an enemy from the 1970s, but as a large underdeveloped country,” explains Rappoport. “They understand that the Russians are not to blame for the policies being pursued in Russia. The same way they look at someone from a third world country.”

Successful businessmen of Russian origin are usually those who have lived in the States for at least 20 years. Albert Wilk, the owner of the real estate company Wilk Real Estate, who grew up in Israel, is one of those people. He manages approximately $80 million in real estate and ranks third among all Brooklyn realtors in terms of sales volume. Vilk managed to work in Russia, but curtailed his activities there in 1994. “Everything there is decided through the cops, the FSB, the GRU and all these organizations. But here everything is decided by the court,” says Vilk. But he is by no means inclined to idealize the situation. According to him, American laws are scary because they are strictly observed, and negotiating with anyone is a lost cause. “Anyone who gets caught by government cops for some problem is almost doomed. The only way to get off the hook is to put someone else on it. For example, someone you know comes and offers to deposit a check. And if I say “go ahead,” then that’s it, it’s over. My “come on” is already enough for me to be imprisoned.”

Does this stop the Russians? Not Yuri Mosha. Although the cases against him in his homeland are closed, he categorically does not want to return. But Russian habits have not gone away. “Once I was on my way to visit relatives in New Jersey, and the police stopped me. The first action was to go after the money. If he had given money, he would have been sent to prison immediately. Thank God, I managed to figure it out and took my hand out of my pocket.” We still need to get used to America.

The art of leaving on time

There are about 300,000 entrepreneurs in prison in Russia. Taking into account the peculiarities of Russian justice, not a single businessman feels protected. Sometimes there is only one chance to preserve freedom - to leave the country. In addition to Chichvarkin, Nevzlin and Berezovsky, more than 60,000 people on the federal wanted list and 1,653 people on the international wanted list are hiding from Russian justice. Foreign states rarely make deals with Russia. According to data from the Prosecutor General's Office provided to Forbes, 213 extradition requests were granted last year - 52 less than in the past, and 167 of them were in the CIS countries. Among the most “responsive” European countries is Germany, which has satisfied about 40 requests over 6 years. Forbes has identified the ten countries where you can most reliably hide from Russian justice.

Canada

It is easy to emigrate to the country: to obtain a Canadian passport you need to have about $1.6 million in your account. Fact: Famous actor Alexei Serebryakov decided to leave Russia after watching the government fight fires in 2010. He finally moved to Canada after the December Duma elections. According to him, the presidential elections were supposed to lead to tightening the screws, after which “any spark could lead to an explosion.”

USA

There is no agreement between Russia and the United States on the extradition of criminals. America extradites its guests only if they have violated American laws, and not the norms of another country. True, even an expired visa may be such a violation.

Fact: one of the few extradited prisoners in recent years - thief in law Vyacheslav Ivankov (Yaponchik) - was extradited to Russia in July 2004, after being released from an American prison. The quick expulsion of the thief in law seemed to be a victory for Russian diplomacy, however, as it turned out, Ivankov was expelled due to the fact that after the annulment of his fictitious marriage, he lost his legal status in the United States and did not have time to obtain a visa.

Who was not extradited: one of the leaders of the Uralmash organized crime group, Alexander Kukovyakin, was wanted in Russia in connection with the bankruptcy of his own Tavdinsky hydrolysis plant. But there is no such article in the UAE Criminal Code, so Kukovyakin was not extradited.

Sweden

Boris Berezovsky and Evgeny Chichvarkin are the most famous of the unidentified entrepreneurs. However, in 2010, for the first time in 100 years, Britain extradited three Russians, including the general director of Denoli, Vladislav Dudko, a large seller of Italian furniture suspected of money laundering.

Israel

Secondly, the first time residence permit is given for only two years, which is comparable to a standard American two-year visa, which can be obtained much cheaper.

Northern Cyprus

Georgia

Before the military conflict with Russia in August 2008, Georgia tried not to extradite even Chechen terrorists. Now a Russian can enter the country without a visa, and the lack of diplomatic relations between the countries makes it impossible to extradite a Russian if he has not violated Georgian laws. It’s easy to become a refugee by complaining about Putin’s regime: but be prepared that local propaganda will mercilessly use you in the information war.

Fact: the absence of a peace treaty and diplomatic relations did not prevent Russia from extraditing two thieves in law at the request of the Georgian special services. Georgia, however, is in no hurry to hand over the three escaped Russian army officers.

Who was not extradited: The Georgian authorities did not extradite Badri Patarkatsishvili, an associate of Berezovsky who was accused in Russia in the LogoVAZ case, but then they themselves put him on the wanted list. As a result, the entrepreneur left for London, where he died.

Thailand

Just like with the United States, Russia does not have an agreement with Thailand on the extradition of criminals.
