The court again reduced the term to Plato Lebedev

The Velsky District Court of the Arkhangelsk Region for three years reduced the sentence of the ex-head of Menatep Platon Lebedev, RIA Novosti reports. Thus, Lebedev may be released in July 2013. The court considered the defense of the convict and the prosecutor's office. “The petition of lawyers is partially satisfied. To finally impose Lebedev’s punishment in the form of ten years in prison in a general regime colony,” Judge Nikolai Raspov announced the decision.

Lawyers asked for re -qualification of charges of a new edition of articles and sentencing "adequate and commensurate", that is, no more than half of the sanction. As the lawyer Vladimir Krasnov considered, "a decrease in the term from 13 years to nine years four months, that is, to actually departed, will be the closest to legal, fair, and certainly to the humane."

According to lawyer Alexei Miroshnichenko, the defense will not file a cassation appeal against the decision of the Velsky court. "We will not file a cassation appeal to the Arkhangelsk Regional Court, but it is possible that later we will appeal this decision in the supervisory authority. First we need to see how the events will develop," the lawyer said.

In turn, the prosecutor spoke out to mitigate the sentence of Lebedev from 13 years to 11 years and 3 months.

In August, the chairman of the court Viktor Ivanov, who for the first time examined such a petition, reduced the term from 13 years to 9 years and 8 months. By this decision, the former head of Menatep was supposed to be released on March 2, 2013. By a decision of the district court, both parties were unhappy. The prosecutor’s office considered that Lebedev should be reduced only to 11 years and three months, and Lebedev’s lawyers insist on mitigating the punishment to the actually served.

On September 21, the Arkhangelsk Regional Court canceled this decision, agreeing that the Velsky District Court did not defeat such a softening. The higher authority canceled the decision by sending a request to reduce the deadline for a new consideration.

Last summer, Judge Nikolai Reasopov refused Lebedev in parole. Lebedev, as for the first time, did not participate in the hearing.

The decision of the Arkhangelsk Regional Court said that the Velsky District Court did not bring specific circumstances of the case when sentencing and, "committed a violation of the requirements of the common part of the Criminal Code and did not take into account all the circumstances provided for by law, necessary to bring Plato Lebedev in accordance with the current legislation."

As a result, the Arkhangelsk Regional Court considered the decision to reduce the deadline for Lebedev’s conclusion “unfair” and canceled it, sending the case for a second consideration. He obliged the Velsky court in determining the punishment in connection with a decrease in maximum punishment under Art. 174.1 of the Criminal Code "give proper assessment to all legally significant circumstances of the case."
