On November 27, in the Zamoskvoretsky Court of Moscow, the sentence was announced to Rasul Mirzaev, who killed a 19-year-old student of the law college Ivan Agafonov in August last year. Mirzaeva sentenced to two years the restrictions of freedom, taking into account the days spent under investigation, in the proportion of 1 day in jail - 2 days of restriction of freedom. Mirzaev’s punishment expired without starting.

According to the testimony of Agafonov's friends, the deceased played at the entrance to the club with a toy machine, then tried to meet the girl Mirzaev in a playful way, offering her to “ride”. The athlete, seeing this, went to Agafonov and asked: “Will you ride me?” Ivan freely joked, but received a blow with his left hand in his face and fell. This blow and a rigid fall on the asphalt eventually caused the death of Agafonov.

According to Mirzaev and his supporters, Agafonov proposed not to “ride” the girl on a toy machine, but “remove” her, which he directly stated in a rude form. The girl replied that she had a boyfriend, after which Mirzaev came up and asked if Agafonov wanted to “remove” him. The student sharply replied that if necessary, he would do so. After that, Agafonov allegedly even intended to attack the athlete, but received a blow. Mirzaev emphasizes that he beat his left hand and open his palm, not going to use his combat skills. Witnesses from Mirzaev claim that the athlete tried to help the fallen Agafonov, rubbing his earlobes.

After the fall, Agafonov woke up, in a shock state was taken to the hospital, where he fell into a coma and died three days later. The investigation established that the doctors in the death of Agafonov was not guilty.

As already mentioned, the 190 -centimeter Agafonov, who weighed 90 kg, was not far from sports - he was engaged in bodybuilding and some combat martial arts. It can be assumed that when Mirzaev approached him, he felt quite confident - the “black tiger” weighed about 66 kg, his height was 168 cm.

“Polit.ru” managed to take a comment from a person who knew Mirzaev to the tragic events of the Garage club: “Rasul is a very open, direct, positive and simple person. As they say, without a double bottom. A little like an adult child. But at the same time - one of the best fighters in Russia. He knows very well what he is capable of, and controls himself absolutely, otherwise he would not be the world champion in combat sambo. In such sports, self -control is needed by 100%. ” Our interlocutor noted that Mirzaev had no need to somehow assert himself due to physical superiority over other people. In addition, it became known that the athlete planned to sign a contract with the UFC (one of the best global companies in organizing battles according to mixed rules) and leave for the United States.

During the investigation, 5 medical examinations were conducted that did not convince the court of a direct causal relationship between the blow of Mirzaev and the death of Agafonov. As a result, the prosecution under 4 of the part 111 of the Criminal Code of the Russian Federation (causing grievous bodily harm) was re -qualified in the charge under part 1 of Article 109 of the Criminal Code of the Russian Federation (causing death by negligence). The maximum term according to the 111th article is 15 years in prison, according to the 109th article - 5 years. The state prosecutor asked Mirzaev’s punishment in the form of 2 years of restriction of freedom, taking into account the days spent by the athlete under investigation, in the proportion of 1 day under investigation - 2 days of restriction of freedom. In fact, the prosecutor proposed to release Mirzaev to freedom, as a result, the judge did so.

The sentence of the sentence lasted more than two hours and 2 times interrupted. The first time because of the father of Ivan Agafonov, who in the middle of the process said that he was “tired of listening to the lies” and demanded that the verdict itself immediately declare. They tried to reassure him, but he was furious from the court building to the street, where he stated that everything that was happening is a lie, and only a point of view convenient for the athlete was considered. To the question of the correspondent of Polit.ru, does he think that there were pressure on other witnesses in the case, Alexander Agafonov irritably replied: “Do you know about it yourself?” The father of the deceased said that his wife was in a hospital with a heart attack for two days. He did not plan to return to court, but by the time the sentence was announced in the hall, he was and shouted “Shame!”.

The second time the sentence was interrupted by the representative of the nationalist movement “Russians” (leader - Dmitry Demushkin), who scandalously left the meeting room. She came to the process as a friend of the Agafon family and shouted that "the death of Russian on Russian land would not remain unpunished." In an interview with the Polit.ru correspondent, she stated that Mirzaev himself knows that he should sit, and that he was released, will lead to interethnic enmity.

I must say that Dmitry Demushkin himself tried to break through to court, but law enforcement agencies did not allow him to do this. In addition, before the meeting, another nationalist, George Borovikov, was taken out of the building. Judging by the video posted on the network, he is now personally familiar with the father of Agafonov.

By the way, the street was also restless. About 50 people gathered in front of the court’s building, some of them, in the Kapki of the LDPR, told the Polit.ru correspondent that the LDPR party monitors the case and generally believe that Mirzaev should be punished strictly, and the laws of the Russian Federation established that the skills of such people in a fight are equated with the use of cold weapons.

Finally, at about two o’clock in the afternoon, Judge Fedin read the verdict himself: “The court sentenced Mirzaev Rasul Rabadanovich to be guilty of committing a crime provided for in paragraph 1 of Article 109 of the Criminal Code of the Russian Federation and appoint him a punishment in the form of a restriction of freedom for a period of two years.” The judge explained that for Mirzaev means a restriction of freedom - the athlete cannot leave his hometown of Kizlyar, participate in mass events and attend entertainment institutions. The court decided to "take Mirzaev on time of serving the sentence of its maintenance in custody from August 19, 2011 to November 27, 2012."

“Rasul Mirzaev is now the same free person as you, I or any other ... He served all the punishment, even more,” commented the verdict for Polit.ru one of the lawyers of the Agafonov family. Another lawyer, Oksana Mikhalkina, said that the verdict will be appealed.

Meanwhile, several people from the crowd standing in front of the court building were detained for nationalist cries. Nationalists generally predict a new “arena” - for them the fight of the Dagestan and Russian, in which the latter gets to the hospital and dies - a favorite plot in which everything is clear. And Mirzaev’s imprisonment for more than a year in jail is not a convincing argument for them.
