In my opinion, the view of a non-lawyer, murder by negligence is when you did not notice a person in a critical situation. And when a person had the goal of using violence against another, and unnecessary violence at that, then this goal itself includes death in the results of the blow.
In fact, that’s why jury trials exist, to consider such cases. In such cases, a jury trial, I believe, should be appointed without fail.
During the arguments between the parties on November 15, the prosecutor asked the court to reclassify Mirzaev’s actions from Article 111 (causing serious harm to health resulting in death) to the “lighter” Article 109 (causing death by negligence). The state prosecutor asked for Mirzaev to be sentenced to two years in prison. According to the prosecutor, “the evidence examined during the judicial investigation and the testimony of witnesses indicate that Mirzaev had no intent to cause grievous harm to the health of Ivan Agafonov.”
