The Simonovsky court of Moscow lifted the arrest from the property of the late Yukos case Vasily Aleksanyan, RIA Novosti reports. Thus, the court granted the petition of the lawyer. In his decision, the court indicated that the criminal case against Aleksanyan was terminated in the summer of 2010 due to the expiration of the statute of limitations. Civil claims of the victims were left without consideration.
This is the third decision of the court to withdraw the arrest. The two previous ones were canceled by the Moscow City Court on the basis that the victims were not notified of the court hearings and their rights were not explained them.
During the court session, the lawyer of relatives of Aleksanyan Gevorg Dangyan said that this time the violations referred to by the Moscow City Court were eliminated. All victims were not only notified of the meeting, but the court also explained their rights on the agenda, but they still did not appear. Thus, the court had the right to make a decision without them.
The prosecutor objected to the removal of arrest from the property, indicating that the victims could still make material claims in the framework of the criminal case of Aleksanyan, since the limitation period did not expire. In addition, the prosecutor indicated that "there are also other criminal cases in which the victims can also show claims," therefore the state prosecution does not consider it necessary to remove the arrest from the property, otherwise it can be lost "due to the disposal of his relatives of Aleksanyan."
In response, the lawyer indicated that the victims could not make a claim to the deceased, because he was not found guilty by the court, the limitation periods have long been expired, if you count from 1998, when, according to the investigation, crimes were charged with Aleksanyan.
Aleksanyan died on October 3, 2011 at the age of 39. In 2006, he was arrested on charges of embezzlement together with other senior managers of Yukos of the property of Tomskneft, as well as shares of oil refineries and oil producing companies in the VNK. For about two and a half years, the former vice president of Yukos conducted in conclusion. In connection with the deterioration of the state of health, lawyers demanded that he change the preventive measure, but the term of imprisonment was extended, and on February 8, 2008, the former top manager was transferred from "sailor silence" to the oncological clinic. In the summer of 2010, the court stopped his criminal prosecution in connection with the expiration of the statute of limitations, without establishing or refuting the guilt of the defendant.
