A verdict was sentenced to the "Twelve case". Former National Bolshes are guilty, but exempted from punishment.
Before the building of the Vyborg District Court of St. Petersburg, in a mess of water and talus snow on December 28, journalists, support group and defendants, waiting for the sentences, gathered-activists of the other Russia party, who were accused of the activity of the National-Bolshevik Party in St. Petersburg, recognized as an extremist and prohibited in 2007. At first, the accused was twelve - and the loud process is called the “twelve business” out of habit - but seven were left by the day of the sentence - with respect to five more production was discontinued behind the expiration of the statute of limitations. Yesterday, the court again resorted to this formulation - with the difference that the defendants were still found guilty and sentenced to fines, which, however, would not have to be paid. They were immediately released from punishment in connection with the expiration of two years from the last episode of “criminal activity”, since judge Sergei Yakovlev excluded all episodes from the case after July 2010.
Andrei Dmitrieva, Andrei Pesotsky and Alexei Marochkin was judged by the first part of Article 282.2 of the Criminal Code (“Organization of the activities of the extremist community”), and Andrei Milyuk, Roman Khrenov, Alexander Yashin and Ravil Bashirov - in the second part of the same article (“Participation in the activities of the extremist community”). The prosecutor demanded fines: for the organizers of the Renaissance of the NBP, 250 thousand rubles, for participants - 180,000. “250 thousand is a half -year budget of our family - I have a wife and a one -year -old daughter,” said Andrei Dmitriev, the leader of St. Petersburg. “After all, they have not been allowed to live since 2009, they introduced provocateurs, set up a rented apartment for meetings, wiretap and hidden shooting, and things began to start for some actions, not for propaganda, but for beliefs-for what we talked about in this apartment there.”
Lawyers Olga Zeitlina, Sergey Golubok and Gleb Lavrentiev generally consider evidence obtained using a police provocation illegal. They still have a lot of complaints about the investigation - for example, to the fact that to prove guilt in a criminal case, the accusation used the materials of several administrative cases. Digossov was regularly detained during unauthorized shares at the Gostiny Dvor, where they on the 31st of each month, where there are such, were defended by the 31st article of the Constitution, guaranteeing Russian citizens freedom of peaceful assemblies, rallies and processions. In the indictment of only one Andrei Dmitriev, it is indeed repeated more than 20 times that the actions organized by him were aimed at expressing intolerance to the senior leaders of the current state authorities, as well as to popularize the prohibited activities of the National-Bolshevik Party interregional public organization.
As a result, the court recognized the arguments of the defense: as Roman Khrenov explained after the almost five-hour reading, “we were found guilty, they were appointed fines, but due to the fact that all the strategies-31 shares that we were charged, the judge did not recognize the evidence in the case, did not recognize them with extremist, in fact, only the meetings remained. And in the meetings we have been published, so that we were released from punishment. ”
Lawyer Sergei Golubok believes that such a sentence - a confession of guilt with the simultaneous exemption from liability - is a replacement of an acquittal, the form that the court can afford without losing the face. Andrei Dmitriev tells how much forces and funds were spent on promoting this case - and comes to the exit that the center of “E” to combat extremism is time to close. Lawyer Gleb Lavrentiev is going to seek a complete excuse for the other Russia. And all the accused are glad that they seemed to be easily escaped, but unanimously they say that they were condemned exclusively for beliefs, since all their faults are in conversations in the kitchen.
