And dramatic, or even tragic, events can await you. What do you want? “You live in paradise, but you have to pay for it,” this is what one of the fraudulent developers of Anapa told the co-investors.
I will introduce the story of these unfortunate people to readers so that they can think while looking at the beautiful advertising pictures of realtors. The amounts of losses vary. One family “from the north” invested 22 million in construction, “buying” living space for themselves and a couple of apartments for “business” - to rent out to “vacation tourists” (how else can you earn money in Anapa?). And five of us northerners have been living in a rented one-room apartment for four years now, with no prospect of getting an apartment or getting their money back.
Attention. The Academy of Housing agency (what else could brokers in heaven be called?) was selling apartments from a developer who had already gone bankrupt, and the realtors knew about it. “What should we do? He (the developer - A.K.) asked for help. But we need to earn money.” This is the explanation the defrauded shareholders received from AN. In heaven all are angels.

Appeal:
Anatoly Ivanovich, on the basis of investment and shared construction agreements, since March 2008 we took part in the construction of a 5-story apartment building, where 23 apartments were sold. The contracts indicated the address: s. Sukko, 2nd passage, 10, cottage No. 3. Attached to the agreements were: Certificate of state registration of land, license for construction of the building site, explication of floors and apartments.
In July 2010, the house was 95% complete, several apartments had no windows and the 5th floor was not plastered. At the beginning of April 2011, the Urban Planning Inspectorate came to us, and we were asked why we did not register ownership of apartments, even in unfinished buildings. We were told to go to court to have the property recognized and the administration would act as a third party in court and help us prepare documents for the apartments. Several residents of the house applied for recognition of ownership of either a share or an apartment in the house, and hired lawyers, but all court proceedings in each specific case ended approximately the same. Either it turned out that there were some documents missing that we could not provide, since the developer had to provide them, or the claim was refused on the basis that there was no building permit. As a result, all cases were suspended until some “circumstances” were clarified. When submitting an application to the court, we learned that the land under our house was re-registered by the developer P.B. Brzhetsev. to another person, although in 2008 we bought apartments along with land. Only land without a building is registered in the Registration Chamber, but according to the latest data taken from the Registration Chamber, not only the land, which no longer belongs to P.B. Brzhetsev, was arrested, but also the house, which, according to information from the same Registration Chamber, does not exist.
Through the efforts of the residents of the house, the following documents were prepared: technical passport for the house, cadastral passport, address certificate, forensic technical examination for some apartments and the house. We installed windows ourselves in the front entrance and in apartments where they were missing, we installed railings, in a word, we ourselves finish everything that was not done by the developer. The house has electricity, sewerage and water supply.
We contacted the Administration of the resort city of Anapa, the legal department, the Department for Supervision of Shared Construction of the Krasnodar Territory, the Prosecutor's Office of the Krasnodar Territory, the Internal Affairs Directorate, deputies V.V. Zhirinovsky, M.V. Emelyanov, A.V. Belyakov, the Commissioner for Rights person, to the Administration of the President of the Russian Federation. All our appeals were forwarded to local authorities, from where we received nothing but lies in response. Repeatedly tried to get an appointment with the former mayor of Anapa T.I. Evsikova, but she always had some reason to refuse us admission.
At meetings of the building's residents, it was unanimously agreed that we would fix all the deficiencies in the construction ourselves. But we need help in registering the right to own a home, since judges always offer their own lawyers, who ask for exorbitant sums for their services. We, pensioners, simply cannot afford them. There is hope that on January 14, 2013, by making an appointment with Sergeev S.P., we will receive help in resolving the problem with the land, and our house will be added to the list of problem properties, and we will be added to the list of defrauded shareholders.

Appeal:

The contracts indicated the address: s. Sukko, 2nd passage, 10, cottage No. 2. Attached to the agreements were: Certificate of state registration of land, license for construction of the building site, explication of floors and apartments.
However, in 2010 it turned out that we were misled, i.e. the land on which the house is being built is the property of G.T. Podyapolsky, on which the unfinished house stood and was demolished by P.B. Brzhetsev. with the consent of Podyapolsky G.T. by oral agreement. There is no agreement between Podyapolsky G.T. and Brzhetsev P.B. was not compiled.
In August 2010, construction was stopped. We contacted the administration, they advised us to go to court with claims for the ownership of a share in an unfinished house. Two shareholders appealed to the Anapa District Court, where the owner of the land, Podyapolsky G.T., was invited. But since Podyapolsky G.T. there was no written agreement with P.B. Brzhetsev. about the transfer of land to shareholders, the judge warned G.T. Podyapolsky. that he urgently draw up this agreement, otherwise he may lose everything. The trial was postponed until the land issue was clarified. Two years later, in August 2012, Podyapolsky G.T. began to take steps to appropriate the house, of which we are investors, and the shareholders fully contributed funds in the amount of about 30 million rubles.
Currently, G.T. Podyapolsky, having made a registration certificate for the house, is demanding that the land with the unfinished house be bought from him for 5 million rubles, threatening to put the house up for sale. On November 6, 2012, we submitted an application to the interdistrict prosecutor's office addressed to A.V. Voloshin. for the developer Bzhetsev P.B. and the owner of the land Podyapolsky G.T. in order to conduct a prosecutorial investigation and bring them both to justice for fraud with land and house construction and extortion of money. No response has yet been received from the prosecutor's office.

Yes, we are not able to do this, since we are all pensioners and disabled people, we sold our apartments, and now we have nowhere to live.

But the people he deceived remember how during a break in one of the meetings he shouted:

He also told people that they were living in paradise, but they had to pay for it. I wonder if Brzhetsev is expected in heaven or is he going to fry in a frying pan?
Apparently, back in the fall he knew the outcome of the trial, knew how the judge’s cards would stack up...
The Anapa court did not suffer any reputational losses, so to speak, due to the long-standing resolution of this issue by public opinion, but the acting. the head lost the support of 2,000 voters. There are so many, they say, defrauded shareholders in Anapa.
