The Duma will complement the Criminal Code of the Criminal Code about the insulting the feelings of believers

The State Duma can make changes to several articles of the Criminal Code at once, which relate to insulting the feelings of believers. This was reported by Gazeta.ru with reference to the chairman of the Committee on Public Associations and Religious Organizations of the deputy from the LDPR, Yaroslav Nilov.

Among the articles in which amendments may appear, Nilov transfers articles 148 of the Criminal Code (obstruction of the right to freedom of conscience and religions), 149 (obstruction of the meeting, rally, demonstration, processing, picket or participation in them), 243 (destruction or damage to the historicals of history and culture), as well as 282 (excitement religious enmity).

These changes will be submitted to the bill on counteracting the insult of the religious feelings of citizens who entered the State Duma at the end of September. He has not yet passed the first reading, but caused criticism of the Council on Human Rights, the Public Chamber and the Supreme Court. They paid attention to the fact that the bill duplicates existing norms. In addition, they suggested that their reviews remove the explanation from the document that the law applies to religion, which constitute an integral part of the historical heritage.

The changes that are supposed to be made to the document, according to Nilov, will have to eliminate this problem. "We proposed this formulation -" insulting religious feelings on the grounds of attitude to religion. There will be believers, unbelievers, and all those faiths that are officially registered, ”he said. - Gentiles, the Old Believers, Krishnaites, Jews, Muslims, Orthodox, Catholics, Protestants - all. "

In accordance with the regulations of the State Duma, they will be proposed as amendments to the second reading. Nilov emphasized that they are not finally formulated, their options are discussed.

The law on insulting the feelings of believers should be adopted as soon as possible. This conclusion was reached by the Presidential Council on interaction with religious associations at a meeting on February 12, which was held by the head of the presidential administration Sergey Ivanov. In his speech, Ivanov said that "it is necessary to make balanced decisions that reflect the interests of the majority: it is important to clearly draw a line between freedom of speech, the right to express self -expression, which, without a doubt, relate to basic values, and frank, militant extremism, speculation on religious feelings."

On January 27, the government sent a draft of this law for refinement. The authors were proposed to "eliminate competition", which may arise due to the fact that some norms proposed in the bill are already present in other articles of the Criminal Code. In addition, some concepts contained in the bill were not defined in the current legislation should be clarified.

Earlier, the Presidential Council for Human Rights proposed equalizing the feelings of believers patriotism, pacifism and other "feelings for different public groups" feelings. Insulting feelings, members of the HRC offer to punish fines and public work, and not by deprivation of freedom. The Kremlin supported this initiative. As a source in the presidential administration said, patriotic feelings are constantly insulting, and their carriers are not able to protect themselves from attacks.

The bill on insulting the feelings of believers, prepared by representatives of all factions, was submitted to the State Duma on September 26. It was proposed to supplement the Criminal Code with Article 243.1 "Insulting the religious beliefs and feelings of citizens and (or) desecration of objects and objects of religious veneration (pilgrimage), places intended for religious rites and ceremonies." The maximum punishment on it will be five years of imprisonment.

It was also proposed to make changes to the Code of Administrative Offenses. According to the article on freedom of conscience and religion, fines will increase to 10,000 - 30,000 rubles for citizens and up to 50,000 - 100,000 rubles for officials. The desecration of religious literature and symbolic signs will be punished with fines from 30,000 to 50,000 rubles.
