The Amur Regional Court abolished the verdict issued by the conspicuous meeting by judge Yevgeny Makhno. According to Lenta.ru with reference to Amur.info, the court returned the case of Andrei Naletov and Sergey Khabarov, accused of fraud, to the prosecutor's office. The defendants were freed from custody on a subscription of a lower away.
The chairman of the court Sergei Semenov explained that the case was returned due to a violation of the rights to protect one of the accused. The accused in court was defended by a lawyer, who also represented another defendant. This defendant subsequently witnessed the prosecution, but the lawyer did not heal himself, so he began to represent the interests contrary to each other.
The case was returned in accordance with Article 237 of the Code of Criminal Procedure. Human rights activist Vladislav Nikitenko, who drew the attention of the media to the case of Naletov and Khabarov, noted that this article involves the return of the case only at the stage of a preliminary hearing. Nikitenko’s remark in the Amur Regional Court refused to comment.
On January 30, Evgeny Makhno asked for resignation after the record where he sleeps during the consideration of the case was on the Internet. The chairman of the Amur Regional Court Sergey Semenov spoke for the dismissal of Makhno.
The appearance of a video with a sleeping judge caused a mass discussion in the blogosphere. In the video, a man in the hall of the meeting, dressed in the judges of the mantle, sleeps, while, judging by the sounds, there is a trial. According to Vladislav Nikitenko, in the frame - the deputy chairman of the Blagoveshchensk City Court for Criminal Affairs Yevgeny Makhno, and the video was made last summer during court debate. The defendant Andrei Naletov was then sentenced to five years in prison in a general regime colony under the article "Fraud in the Entrepreneurial Sphere."
The verdict could be softer, since Nakolutov had a civil wife and a minor child with cancer. Meanwhile, according to Nikitenko, the judge missed these circumstances because he slept at the meeting.
In turn, the chairman of the Annunciation City Court Pavel Belousov, not denying the guilt of his subordinate, tried to justify him. According to him, the case with the falling asleep Makhno demonstrates the "tremendous loads", which fall on the judges.
