The investigation issued a decision to terminate the criminal case and criminal prosecution against the former prefect of the Northern Administrative District of Moscow Yuri Khardikov, who was suspected of embezzlement of assets of billion rubles among the wife of the former Moscow Mayor Yuri Luzhkov, Elena Baturina. The investigation also abolished the arrests previously imposed on Khardikov’s property, his lawyer Lyudmila Sidorova told RIA Novosti .
"The decision also noted that Khardikov has the right to rehabilitation and compensation for harm related to criminal prosecution," she said, adding that she intends to discuss this issue with her client.
Note that the termination of the criminal prosecution of Prefect Sidorov reported even earlier. According to her, the case against Khardikov was closed "on the eve of the New Year."
According to Sidorova, the investigation came to the conclusion that the legal relations arose between Khardikov and Baturina to acquire a 90% share in the authorized capital of Olympus-2014 LLC with the property owned by real estate objects, do not have signs that could attribute them to the category of crimes and characterize as a criminal act, and all subsequent disputes related to related the property of Olympus-2014 LLC is exclusively civil law.
“This case came to a logical end. It should not have been initially at all,” Sidorova concluded.
What Elena Baturina accused Yuri Khardikova
The wife of the ex-mayor demanded 1 billion rubles from the prefect, accusing him of fraud when selling her 90% of the share of the authorized capital of Olympus-2014 LLC. Allegedly, Khardikov convinced Baturin that this LLC owns land plots in the Krasnodar Territory and construction sites in Sochi, which the LLC did not actually own.
Baturina bought property from the mother of Yuri Khardikov - Zinaida Sadovnikova. The representative of the seller was the ex-preservation himself.
In November 2009, the Tver court of Moscow in absentia decided to arrest Khardikov, after which he was put on the international wanted list.
Meanwhile, Yuri Khardikov went to Lithuania, where he received the so -called additional protection (such a thing as "political asylum" in this country). In March 2012, the term of "additional protection" was extended for another year. In December, the decision to attract Khardikov in the fraud case as the accused was canceled, absenteeism was removed from him.
Khardikov complained that he was not allowed to Russia. And Baturina threatens Strasbourg
Note that in Lithuania, Khardikov also had problems with the law. In August 2010, he was arrested and accused of legalizing 36 million liters (more than 10 million euros).
In an interview with Izvestia, the ex-preservation said he was hoping to return to Russia, since he has "mom, children." However, for this he will have to solve a number of technical issues. For example, he does not have a Russian passport, and the consular department of the Russian embassy refused to issue it.
In addition, he did not rule out that Baturina would try to achieve the resumption of the investigation. Baturina lawyer Marina Gorbacheva indirectly confirmed these fears.
Commenting on the message about the termination of the case against the ex-preservation, she said that she considers it absolutely illegal: "I first hear about it from you. It turns out that the investigators, making a decision to terminate the criminal case, once again not notified, which was violated by Elena Baturina. At the same time, the decision is absolutely illegal, because Hardikov’s guilt is obvious."
According to Gorbacheva, the decision will be appealed. Moreover, Elena Baturina, in evidence of her innocence, is ready to reach the Strasbourg Court.
