The Moscow Arbitration Court on Thursday refused to bankrupt the company of businessman Sergei Polonsky, Potok and 0458, formerly called Mirax City, and to introduce surveillance into it at the request of StroyMontazhUpravlenie 321 CJSC.

The court left the application of the StroyMontazhUpravlenie 321 company without consideration, the RAPSI agency reported . This was done on the basis that, as the court learned, Polonsky’s company paid off its debt to the applicant in the amount of 3.5 million rubles.

In two weeks - on April 26 - the Moscow Arbitration Court will consider the validity of the request of another company - ZAO Design and Production Company AK - to declare Potok & 0458 bankrupt. Polonsky’s company owes her 32.6 million rubles.

In November 2012, the arbitration court terminated the proceedings at the request of another company, the Kaliningrad-based LLC Euro-American Glazing Engineering, which demanded that Potok & 0458 be declared bankrupt. A lawyer for Polonsky's company told the agency that the proceedings in the case were discontinued due to the lack of legal grounds. According to him, the company's main debt was paid off, and penalties "cannot be declared as a basis for filing a bankruptcy petition."

Mirax Group (renamed Potok) was created in 1994. Among the company's largest projects are the business complex "Federation" in the MIBC "Moscow City", business centers Mirax Plaza, "Poklonnaya, 11" and "Admiral", residential complexes "Fort Kutuzov", "Kutuzovskaya Riviera", "Rublevskaya Riviera", Mirax Park, "Golden Keys 1, 2", Well House and others. Potok's public debt is about $600 million. The amount of debt to apartment buyers and contractors was not disclosed.

At the beginning of March 2011, at a meeting with journalists, Mirax founder Sergei Polonsky announced that he was no longer a businessman. According to him, the developer’s board of directors decided to close the Mirax brand. In June 2012, Sergei Polonsky stepped down from the leadership of the Potok group of companies.

In October, Potok reported that businessman Alexey Alyakin entered into preliminary agreements with Polonsky to purchase 100% of the company's shares. But in mid-February 2013, Polonsky, while in prison in Cambodia, sent an e-mail order to dismiss Alyakin from all positions in the organization. Potok also disseminated information that during the management of the company Alyakin withdrew funds and real estate totaling more than 2 billion rubles.
