Members of the cooperative SPK "Persianovsky" continue to defend the rights to their land, despite the fact that there is an obvious raider campaign against it. Over the past few years, attempts have been made by third-party commercial entities to seize lands owned by the cooperative. And they are trying to remove its chairman, Anatoly Mikhailovich Rubtsov, “under any circumstances,” trying to put in his place a person controlled by interested parties.
And it all started out banal. On May 2, 2012, on the initiative of one of the former members of the cooperative, Alexander Evgenievich Kalinin, a general meeting of members of the Persianovsky SPK was held, at which Mr. Kalinin raised the issue of leasing to Persianovsky LLC the land owned by the SPK with a total area 5971179 sq. meters with cadastral number 61:28:60 0012: 0315 for 10 years.
Of the 35 people present at the meeting, 21 owners (more than 50%) voted against concluding the agreement and against granting the corresponding powers to Mr. Kalinin. After which the meeting ended, and the members of the cooperative dispersed, confident that the land they owned remained at their disposal.
Imagine their surprise when, after some time, they learned that the lease agreement with Persianovsky LLC, Mr. Kalinin, had nevertheless been concluded, and the “bona fide” tenant was in full swing preparing to register this agreement with the Office of the Federal Service for State Registration, Cadastre and Cartography in the Rostov region.
In order to prevent the illegal deprivation of cooperative members of the opportunity to use and dispose of the land plot belonging to them, to the head of the Oktyabrsky Department of the Office of the Federal Service for State Registration, Cadastre and Cartography for the Rostov Region, Sytnik I.Yu. a letter was sent, signed by 31 members of the cooperative, where a ban on performing any registration actions with the specified land plot belonging to the SPK was written in Russian, as well as information that the members of the cooperative did not allocate Kalinin A.E. appropriate authority to enter into a lease agreement.
The letter was successfully registered on 07/09/2012 in the Federal Service Administration of the October Department. However, despite this, on August 17, 2012, the lease agreement was nevertheless “registered” under number 61-61-34/034/2012, which members of the cooperative learned from a letter to the SPK from the general director of Persianovskoe LLC, Sukhovenko .L.
How did this happen? We started to look into it and this is what turned out to be: it became known that A.E. Kalinin, probably by prior conspiracy with other persons, forged the minutes of the general meeting of participants No. 1 of May 2, 2012, completely distorted its text, the course and voting results. The protocol was signed by A.E. Kalinin, V.N. Fetisov. and Deputy Head of Administration Prokopov A.S.
In reality, everything was quite the opposite. At this meeting, no decision was made to conclude a lease agreement; Kalinin A.E. was not authorized by any authority. was not vested, and all essential terms of the lease were not discussed or agreed upon. And that's not all, let's continue:
— the actual voting results are not reflected in the protocol;
- the list of registered persons does not correspond to reality, in particular, Tatyana Mikhailovna Rudenko, Sergey Aleksandrovich Zhuravlev, Anatoly Ivanovich Rudenko, who were not present at the meeting, are registered in it;
— the text of the minutes of the meeting does not correspond to the text of the registration log, which indicates that some of the sheets with signatures were added to the minutes later. On the first sheet of the protocol it is indicated that the secretary of the meeting is T.V. Kiseleva, but the protocol itself was signed by another person - L.N. Fetisov;
- the logbook of registration of meeting participants was kept only by I.V. Panakhalieva, while, having received the protocol with the logbook attached to it in accordance with Part 11 of Article 14.1, members of the SPK saw that some sheets had been removed from it and names were added at the end by unknown hand.
Currently, Mr. Kalinin is happily an employee of Persianovskoe LLC, which once again indicates that by concluding a lease agreement that was enslaving to the members of the cooperative, he was not acting in the interests of the people.
Could he pull this off alone? Of course not, agronomist Kalinin is far from the immortal Bender! There is an opinion that other persons helped him in this scam, in particular V.N. Fetisov. and Prokopov A.S. (Deputy Head of Administration of the Krasyukovsky rural settlement).
At the moment, the regional OEB and PC are “interested” in the case, and this despite the fact that after the first publication (“Racing on tractors in other people’s winter crops”) the author of this text received a call from the Bison press service and was assured that the land belonged to them by right, and the members of the cooperative sowed it illegally. Meanwhile, the deadline for settlements with creditors for the members of the cooperative is getting closer and closer, but there will be no harvest...
