According to the lawyer of the company “Your New Address” Andrey Veshkin, the actions of the bankruptcy trustee are within the law and are in no way related to the company’s claims to the fitness center. “Mr. Semenov unilaterally terminated the agreement with Energy-Sport and entered into an agreement with Transport-Service LLC, which is registered in the cadastre and cartography department of the Sverdlovsk region. This happened because the amount of rent the fitness center was paying was underestimated. Initially, he contributed 200 thousand rubles per month, since August 2012, 400 thousand per month, and Transport-Service LLC offered an amount of 700 thousand rubles,” he emphasized. According to him, within the framework of the bankruptcy law, the bankruptcy trustee has the right to terminate the contract unilaterally if this infringes on the interests of creditors. “In addition, when concluding an agreement with Energy-Sport, the consent of the mortgagee of LLC “Your New Address” was not obtained, and under the agreement with LLC “Transport-Service” we gave such consent, since their terms will be beneficial for the lender,” - Mr. Veshkin explained.
