Maxim was detained on May 28 on suspicion of participating in the riots during the "Million march". According to investigators, "the suspect on May 6, during mass events, broke through the police cordon, beat policemen and legs, applied law enforcement agencies providing public order who suffocating receptions."
2 days after the detention to Maxim, lawyers and relatives were not allowed, they kept him in the cell without food and water, and expectedly beat him.
As a result, Maxim pleaded guilty to both articles, identifying himself in the photographs in which a man in a mask applies violence to a policeman. According to lawyer Sergei Shushpanov, there was no deal with the investigation.
According to the conclusion of the public prosecutor, on May 6, 2012, Maxim Luzyanin, who was at the rally “For Honest Elections!”, “Having a criminal intent, inflicted bodily harm to five riot police fighters.” Namely - Prokhorov, Kruglov, Kazmin, Markov and Stalkin.
During the hearing, the lawyer asked to pay special attention to gratitude to the defendant from the bodies of the local department of Podolsk and the Moscow diocese of the Russian Orthodox Church. Luzyanin was thanked for the conduct of sports events and the contribution to the spiritual, moral and patriotic education of youth. Luzyanin’s mother, caused as a witness, noted that aggression was not characteristic of her son and asked “not to punish him strictly.”
The lawyer and the client focused on the fact that during confrontations, Luzyanin apologized to the victims and exchanged hands with some of them as a sign of reconciliation. One of the victims of the riot police accused through his wife paid for treatment - the restoration of dental enamel. In general, the defense line was built on the fact that although the accused is to blame, his behavior in Bolotnaya Square is not characteristic of him and caused by external factors.
Nevertheless, the state prosecutor demanded the sentence of Maxim Luzyanin to 6 years and 6 months of a general regime colony. According to the prosecutor, Luzyanin acted along with the other sixteen accused, although they were not familiar before. All of them inflicted “substantial damage” to the city budget: “They destroyed the asphalt coating in the amount of 28 million rubles, damaged the closets by 70 thousand rubles, and caused the Main Directorate of the Ministry of Internal Affairs of 25 thousand rubles.” “As a result of the mass riots, accompanied by arson and violence, the Main Directorate of the Ministry of Internal Affairs and the Main Directorate of the Ministry of Internal Affairs lost 14 body armor, 29 rubber sticks, 2 megaphones, 2 helmets.”
On November 9, the judge of the Zamoskvoretsky district court Andrei Fedin handed Maxim Luzyanin the verdict under two articles of the prosecution - 3.5 years under Part 2 of Article 212 and 2 years under part 1 of article 318. By partial absorption, the verdict amounted to 4 years 6 months.
On January 23, 2013, the Moscow City Court left the verdict unchanged.
On April 2, 2013, Maxim Luzyanin received a sentence in the FKU IK-6 of the Federal Penitentiary Service in the Tula region to the city of Novomoskovsk.

According to the member of the committee on May 6, Sergei Davidis , “the sentence to Luzyanin - 4.5 years - showed that many suspicions of his attitude were in vain. He chose guilt and a special order, perhaps because he already had criminal experience in a non -building case, where this is a completely natural way to facilitate fate. Moreover, this is understandable in his situation, when violent acts regarding police officers are recorded on the video. But, contrary to expectations, Luzyanin, apparently, did not specify anyone, which probably wanted the investigation, did not testify on the “organizers” invented by the investigation, did not lie that he had come at someone's call or for someone’s money. I think such a harsh sentence is connected with this. The investigation needed not an honest recognition, but a reservation of others. Then he would, I think, received a year, if not less. But Maxim Luzyanin, to his honor, apparently did not go to this. "
