
On Tuesday, May 7, at 14:00 in the 417th section of the Presnensky District Court of Moscow, the trial of the chairman of the Consumer Protection Protection Society Mikhail Anshakov will continue. He is accused of slandering the fund of the Cathedral of Christ the Savior. Part 2 of Article 128.1 of the Criminal Code, Anshakov faces a fine of up to 1 million rubles or mandatory work for up to 240 hours. The victim in the case is the Executive Director of the Fund Vasily Poddevalin.
According to the indictment, approved by the first deputy prosecutor of Moscow, Alexander Kozlov, Anshakov’s statements were recognized in an interview entitled “The product is consecrated. The exchange and return is not subject to return”, which was published in Novy Gazeta in September 2012. In this interview, the head of the OZPP said that the XXS actually operates a business center where the offices of 15 commercial firms are located, a car wash, a car service, a tire fitting, a parking lot for 305 cars, a laundry room, a dining room and numerous pavilions selling jewelry, souvenirs and other shirpolarb.
The first meeting in the case took place on March 29 in the absence of Poddornalin. Anshakov refused to find himself guilty. After that, three witnesses of the prosecution acted. Judge Dina Gusakova asked to notify Poddornalina that if he did not appear at the second meeting, he can be delivered to the court in accordance with the Code of Criminal Procedure.
At the second meeting held on April 10, Poddornalin said that part of the territory of the temple complex is really leased, and also confirmed the work of commercial structures in the premises of the temple. The head of the fund noted that the founders of one of the enterprises - the car wash "Mytnoye" - are his children. At the same time, Poddornalin called the falsehood the statements contained in an interview that he was "sitting on cash flows" and that the business center was actually built on donations. "
Anshakov, in turn, read out a list of companies renting premises in the temple. In total, 45 firms were on the list, although Poddevalin provided information only about 15. The head of the OZPP explained this by the fact that the rest of the enterprises operate on the territory of the temple unofficially. Anshakov also said that representatives of the Chechen, Armenian and Arabic diasporas conduct commercial activities in the temple. Finally, he noticed that the children of Poddevalin from firms in the temple, in addition to the car wash, are owned by the company "Zheleznodorozhny Pharmacies" and the BSP "Bell", although the security agency is now issued for other persons.
The defense of Poddornalina requested the transfer of a meeting in connection with the non -appearance of the author of the interview with journalist Elena Masyuk. She was called by the summons at both past meetings, but she did not come to any of them. Gusakova decided to provide her forced drive. Masyuk has already given testimony during a preliminary inquiry in December 2012, but the parties to the victims and the prosecutor want to interrogate it in court.
Nevertheless, Masyuk was not even at the third meeting, held on April 17. The bailiffs, who came to the journalist, to bring her to the hearing, said that no one opened the door to them. Meanwhile, the editorial office of Novaya Gazeta informed the judge that Masyuk was on a business trip. As a result, the defense of Poddevalina abandoned the demand for the personal appealed of the journalist, and the judge read out her testimony, data earlier.
Anshakov and his lawyer filed several petitions, including calling witnesses of protection and to exclude a number of evidence as unacceptable. However, the judge satisfied only one thing - about introducing an extract from the tax inspectorate to the case file about 25 firms operating in XXS without lease agreements.
After that, the court completed the study of evidence of the prosecution and protection. However, the prosecutor asked not to complete the judicial investigation, citing the fact that he needed time to prepare additions. Gusakova agreed to postpone the meeting.
Earlier, deputy prosecutor Kozlov tried to attract Anshakov for slander under an administrative article, however, on October 19, 2012, the judge of the 350th section of the Savelovsky District Court justified him in the absence of an offense. After the article on slander returned from the Code of Administrative Offenses to the Criminal Code, a criminal case was opened against a public leader. This is the first thing about slander, open after the return of the article in the Criminal Code.
