The Ministry of Economic Development opposed amnesty for entrepreneurs: it is difficult to hold a line

Deputy Head of the Ministry of Economic Development Sergei Belyakov spoke out against the idea of ​​conducting an amnesty of entrepreneurs convicted on economic issues, RIA Novosti reports.

“The act is condemned not on the basis of who committed it, but on the basis of what was done and what a person was guided by. How could one be the same crime, for example, fraud, to relate differently and give qualifications of actions depending on whether an entrepreneur or an entrepreneur,” he explained his attitude to this proposal in an interview with journalists.

The Ministry of Education, a lawyer by education, is responsible for public-private partnerships and cooperation with business.

“To those whose rights are infringed, what difference does it make, who deceived him is an entrepreneur or not an entrepreneur. And how to draw a line between a socially dangerous action of an entrepreneur and socially incredible. Who will determine whether he deserves a special relationship or not,” the deputy minister wondered.

At the same time, he emphasized that we need to talk about reducing sanctions for such crimes in principle, regardless of who committed them, and also decide - "whether it is necessary to give real time or is there enough conditional."

“It is necessary to mitigate the punishment, but you can’t just all the costs of the judicial system, the work of investigators, law enforcement agencies, which often really are repressive, compensate for the fact that we will let everyone out,” Belyakov said.

Recall that with the initiative about the amnesty of convicted entrepreneurs, Boris Titov, an authorized manner under the President of the Russian Federation on the President of the Russian Federation on the President of the Russian Federation. He proposed to coincide with an amnesty for the Entrepreneur Day, celebrated on May 26. Many experts supported this proposal, noting that the amnesty will positively affect the country's investment climate.

However, on May 23, at a meeting with entrepreneurs in Voronezh, Russian President Vladimir Putin said that the project is still raw and it must be analyzed. One of Putin’s arguments was that the category of “excessive punishment for an economic crime” is completely different people who could do much more harm.

Titov and representatives of the business community who supported his idea propose to declare an amnesty for more than 40 articles of the Criminal Code, including articles on deliberate bankruptcy, fraud, causing property damage, illegal banking and entrepreneurial activity, legalizing, manipulating the market and tax evasion.

After the President’s criticism from the amnesty project, apparently, articles on bank cards will be excluded (Articles 159.3 and 187), criminal export of dual -purpose materials (Article 189) and illegal manufacture of money (Article 186).

Another condition for the liberation of entrepreneurs may be compensation for losses to the victims. The latter, for example, will become an obstacle to the liberation of the ex-owners of Yukos Mikhail Khodorkovsky and Plato Lebedev: by court decision, they must pay 17 billion rubles.
