In St. Petersburg, a verdict was sentenced in a high-profile case of the raider seizure of the Frunzensky fruit and vegetable plant. Among the convicts was the once -high -ranking guard Vladimir Sych, who acted in conspiracy with his subordinates.
By the decision of the judge of the Frunze District Court Julia Martsinkevich, the former deputy head of the St. Petersburg Organized Crime Control Department Vladimir Sych received five years in prison. Exactly the same punishment is determined by his accomplices Alexander Rozhkov and Yegor Lisitsyn. The fourth defendant Igor Lukonenko received 4.5 years in colony conditionally, RIA Novosti reports.
In addition, Alexander Rozhkov was appointed a fine of 700 thousand rubles, said the official representative of the RF IC Vladimir Markin.
"The investigation and the court established that from July 2005 to October 2006, Sych, Lisitsyn, Rozhkov and Lucenko, using fake documents, stole 100% of the shares in the authorized capital of Frunzensky Fertical Combine LLC," the RF IC said.
As a result, they received the right to premises an enterprise worth at least 513 million rubles.
According to investigators, the raider gang was led by the "authoritative" businessman Mikhail Slyozberg, who moved to Israel. Before the capture of the plant there in July 2005, a police check was carried out by the sanitary and epidemiological condition. OBEP employees Tatyana Mishchenko and Evgeny Shumilo took part in it. They subsequently charged fraud and exceeding official powers.
According to the case materials, during this audit, seven certificates of the ownership of the FPK for real estate are seized. Subsequently, these papers helped the raiders reissue documents for the right to own the enterprise.
Vladimir Sych, according to investigators, in October 2005 ordered his subordinates Azeru Aliyev and Vasily Borovitsky to receive samples of Semen Shubik Semen (now the late main owner of the FPK). Under the pretext of a handwriting examination, they received samples and handed over sheets to their leader, the newspaper Kommersant writes. Then they were used to reissue the documents of the FPK.
The case of Sych’s assistants was considered in the Oktyabrsky District Court of St. Petersburg. As a result, Borovitsky escaped the punishment "in connection with the expiration of the statute of limitations", and Aliyev and his lawyer achieved an acquittal.
Egor Lisitsyn, investigators believe, acted as a fictitious director of the FPK, and also participated in the manufacture of fake documents, went to the seizure of the enterprise, misleading law enforcement officials about the legality of actions.
Lawyer Igor Lukonenko gave consultations on paperwork, controlled Lisitsyn’s actions, and also went to capture the plant.
Alexander Rozhkov advised the alleged organizer, and also made fake documents.
As a result, the under investigation was charged with part 4 of article 159 (fraud) of the Criminal Code of the Russian Federation. In addition, Sich was charged under Part 1 of Article 286 (abuse of authority) of the Criminal Code of the Russian Federation, writes Fontanka.ru .
In addition, Vladimir Sych organized contacts and held negotiations with representatives of competing criminal groups and law enforcement officials investigating the criminal case, instituted on the fact of unlawful seizure of FPK LLC. At the same time, he "formed an erroneous opinion on the circumstances of the crime and a negative attitude towards the victim, " Baltinfo reports.
Nevertheless, the Russian Themis, represented by Julia Martsinkevich, did not agree with the investigation on the qualification of the crime. The judge decided that the bandits are not guilty of fraud, but only in the attempt on fraud.
It should be noted that the prosecution was based on the testimony of the witness of Badri Schengelia, who in St. Petersburg is considered the "ideologist of the raider movement." It was Vladimir Sych who carried out his operational development in the criminal case, and as a result, Schengelia was convicted several years ago.
It is also noteworthy in which the "nervous atmosphere" was carried out by the investigation. The case even came to a skirmish in the office of a judge , in which the court workers fought for a witness.
Meanwhile, the lawyer of Sychy Igor Sochants intends to appeal even such a mild court decision. “Nothing is actually objective in the sentence, and it is extremely difficult to understand,” he said.
