Due to the fact that during the investigation of the criminal case, sufficient evidence of Durov's intent to use violence against a policeman was not collected, Durov's actions were qualified by the investigation under Part 20.1.8 of the Code of Administrative Offenses of the Russian Federation (malicious disobedience to the demand of an internal affairs officer).

Materials confirming the commission of the said administrative offense were separated from the criminal case and sent to the Main Directorate of the Ministry of Internal Affairs of Russia for St. Petersburg and the Leningrad Region for a decision to be made, and the criminal prosecution of Durov was terminated due to the absence in his actions of the corpus delicti under Part 1 of Art. 318 of the Criminal Code of the Russian Federation.
