In his complaint, Alexei referred to the fact that in his case there was no evidence of guilt, procedural violations were committed, and that the October court did not take into account the size of his earnings and the decision of the Constitutional Court of February 14, 2013.
This time, the request for the call of the witness was satisfied, and Nyl Ibragimova was invited to the meeting. According to Nyli, she was present at the shares of the accused as a public observer, where he invited her himself, saying that he would conduct a single picket. She also explained that she watched only his action, and Kulbakin noticed only at the end of the consumption picket.
But during the announcement of the sentence, Judge Istomin called the testimony of Ibragimova confirming the fact of the violation, and evidence of the violation-the protocol on the offense, video recordings from outdoor surveillance cameras and the plan of the location of the picketers. Also confirming the evidence of guilt, the judge named the testimony of the inspector of the Public Order protection department of Popov, who testified at a meeting of the district court, where he explained that he personally did not see how the picketers were gathering before the action. And the number of procedural violations considered insufficient to cancel the sentence.
Recall that Alexei consumables was accused with Tatyana Kulbakina for the fact that, according to the Ministry of Internal Affairs, they organized picket by a group of persons during a prayer service for the city day, without coordinating it with the administration. The cases of both were considered by judge Makarova. Tatyana’s proceedings were suspended due to numerous procedural violations , and Alexei received a fine of 20 thousand rubles.
According to activists, the difference in their case is only that the consumers put his signature in the protocol on the offense, indicating that he did not agree with him, and Kulbakin could not find this with the protocol.
