In the Moscow City Court, hearing in the case of the so -called mass riots on Bolotnaya Square on May 6, 2012 continues: the prosecution is of evidence. On July 9, the first witness was performed, which could not stand the onslaught of the defense, and the judge suffered interrogation the next day. 
The public on the "Swamp process" is becoming more and more every day. This, of course, is not about hundreds of visitors and, alas, not about thousands - about several dozen. The hall accommodates no more than forty people, and in addition to relatives, friends of the defendants, journalists, politicians, human rights activists come. The atmosphere in the hall is no longer so oppressive, and the bailiffs seem to be slightly used to lawyers and public and do not rush, like kite, when one of the friends or sympathizers in the break turns to the defendants with words of support or with questions.
The sixth day
As soon as the door closes in the hall No. 338, Judge Nikishin comes out of the deliberate room, a slightly languid voice announces a roll call of lawyers and defendants, notes that one of the defendants, Maria Baronova, as always, is late, and one of the lawyers is still going to the subway, and his colleague has to protect his client.
The judge announces a break before the arrival of Baronova. Fifteen minutes later Masha appears. She runs into the hall, sits in her place next to the Aquarium and tells the defendants the latest news. "Have you heard that the Twitter of the President Obama was hacked?" She asks. Someone from the Aquarium replies: “Yes! And Putin will find a refuge in Paris. ”
The bailiffs are surprisingly merciful: Baronova’s communication with boys in the Aquarium is not interrupted.
The break ends, the judge enters again, Zhurov Baronov for being late, and she explains him by the fact that he lives on the top floor and her roof flowed. “I promise that I will behave decently,” Baronova says. “You already promised this,” the judge smiles condescendingly and, finally, begins the process.
Mobile phones are unanimously stopping working: as one of the bailiffs will explain to me later, special muffins were installed in the Moscow City Court.
Absurdity erected into the system
The coolness of the air conditioner is replaced by stuffiness in an hour. The voice of the prosecutor, muttering under his breath, lulls. You feel like a submarine: there are no windows in the hall. Gradually you get used to the “aquarium” cage, in which, having clung to each other, ten people are sitting, and to the absurd of this process, which, in principle, cannot be used to.
For example, a young tanned prosecutor with long painted eyelashes, in a short skirt and high-heeled shoes, reads a forensic medical examination against riot police Andrei Arkhipov, who performed at the last meeting. This riot police on Bolotnaya Square, unidentified faces “fell into the face,” and he has a “bruised wound” on his chin. At the same time, as stated in the examination, the wound is only “short -term harm to human health”. And the forensic medical examination itself was carried out in the absence of this riot police, which in itself is also absurd.
Lawyers take turns in turn, urging the judge to admit this examination “unacceptable evidence” and caring many arguments. Firstly, the prosecutors read the story of the bruised wound of Arkhipov on a copy of the medical examination, and the question of the defendant Krivov (dressed in a white T-shirt with the inscription Khodorkovsky Go Home), where the original examination is, cannot answer-or do not want to. Secondly, the injured riot police at the previous meeting said that he did not know any of the defendants and did not believe that he was “affected” precisely from them.
“He suffered from“ mass riots, ”the lawyer Dmitry Agranovsky explains The New Times,“ and most of the victims that are in this matter were also affected not from specific persons and not from our defendants, but from unidentified persons. In accordance with the decision of the Plenum of the Supreme Court of July 26, 2010, it is necessary to find out how these so -called victims received their status. ”
Judge Nikishin, after listening to the objections of the defenders and defendants, refuses to recognize the forensic medical examination unacceptable evidence, thereby taking the side of three prosecutors. The auditorium does not withstand and bursts out with laughter - the judge quite obviously supports the prosecution. Nikishin reacts instantly: "A bearded man in the third row, leave the hall!"
"I?" - the artist Kirill Kozakov is surprised. He really laughed, but with everyone. "Yes, you!" - the judge is echidized.
Kozakov gets up and waves his hand to those who remain in the Aquarium.
The prosecutor reads some other papers related to the organization of the action on May 6, 2012 in Bolotnaya.
At this time, lawyer Samarin reads the New Gazeta, lawyer Makarov-some thick book in English, one of the activists passes the application to the European Commission for the inadmissibility of the continuation of the “torture court” in the “swamp case”. Everyone is signed.
The prosecutor finishes reading.
“Given the fact that the defendants have been in the hall for a long time, a break for half an hour,” the judge proclaims, defiantly indicating that he behaves highly humane.
The accused is taken to the convoy "glasses", the audience diverges: who smoke, who to have lunch. The defendant Alexander Dukhanin with an electronic bracelet on his leg, in a lemon-colored cloak, sits on a bench in the lobby of the court, lively talks about something and hugs with her fiancé.
Relatives of the defendants whisper that a representative of the American embassy was supposed to come, but no one knows him by person, so it is not known whether he came to this meeting or not.
Alexei Navalny came to the Moscow City Court at the beginning of the process, but did not go into the hall: he was a witness to the case. The fact that he came to support the "prisoners of Bolotnaya" will tell lawyers. A few hours later it becomes known that the office of the corruption founded by Navalny came with a search from the Investigative Committee.
The first witness
After a break, prosecutors begin the interrogation of their first witness - “important”. “Dmitry Deanichenko, head of the Center for Special Forces of the Main Directorate of the Ministry of Internal Affairs,” he appears. During the events of May 6, 2012, Deanichenko was the deputy head of the Department of the Main Directorate of the Ministry of Internal Affairs of the Russian Federation for Moscow and the deputy chief of the operational headquarters for the protection of order at the rally.
Deanichenko says that he was present at a meeting at the Moscow City Hall on May 4, when the details of the rally with its organizers were discussed, and the next day he developed a plan for the protection of public order. It was within the framework of this plan, according to the witness, in the square in front of Bolotnaya Square, a restrictive chain of police officers was installed, who, according to Deanichenko, restrained those who wanted to break into a large stone bridge.
Deanichenko admits that he heard well as the organizers of the rally, in particular Sergey Udaltsov, called on people to go to the Kremlin to arrange mass riots.
"Was the force on the side of the protesters in relation to the police?" -one of the lawyers asks a witness.
“As can be seen from the videos, during the breakthrough, the participants in the action threw pieces of asphalt, used gas cans,” Danichenko recalls.
"So you witnessed the events or the TV?" - clarifies the lawyer Makarov.
“I was on Serafimovich Street, I myself saw everything,” Deanichenko quickly recovers.
But lawyers do not let up.
Dmitry Agranovsky: “You said that you found a tent rally from the organizers of the rally. Why did you take them away? Are these prohibited items? "
Deanichenko: "The organizers said they were not related to these tents."
Agranovsky: “On the basis of what legislative acts did you abduct these tents and delivered them to the Yakimanka police department? What is a “limiting guide chain of riot police”, which you put in the square, where people could not go? This was not agreed with the organizers of the action. They arranged a sedentary strike precisely because they were not allowed to go into the square. In connection with what did you put up this chain? "
Deanichenko listens to all questions and is silent. The hall laughs.
Masha Baronova continues the execution: "Are you telling the truth?"
The witness does not answer again.
“Why, in the certificate on the results of ensuring public order and security in Moscow on May 6, 2012 , which you submitted to your leadership, did you write that there were no emergencies?”
In response - silence again.
Lawyers continue to attack the witness with questions, and the judge almost does not limit them. After an hour and a half, Deanichenko gets tired and begs the judge: "I need to leave." Nikishin, having mercy, transfers his interrogation the next day.
“Freedom, freedom! - Activists who did not fall into the hall shout from the corridor and awaiting the end of the meeting in order to catch this phrase. The defendants in the Aquarium wave their hands to their mothers, fathers and wives. Lawyers give comments. Life continues. And on the street two bailiffs smoke - young and older. One explains to the other what is happening in Hall No. 338: “Udaltsov is their leader. He was preparing a coup ... "
