In the Moscow City Court on July 11, the third day in a row interrogated the colonel of the police, Deanichenko. The lawyers managed to catch him on contradictions in the testimony. And under the curtain of the court hearings, a scandal erupted: Witness Deanichenko spoke about his “trusting relationship” with one of the organizers of the rally on May 6, 2012, a member of the opposition coordinating council Peter Tsarkov.
The eighth day of the hearing in the “Swamp Things” began, as always, with a delay: once again Masha Baronova lingered. When she arrived, the court again summoned to testify Colonel Deanichenko. His interrogation was continued by the lawyer of Sergei Krivov Vyacheslav Makarov. All issues of the lawyer mainly concerned the possibility of demonstrators to go to the square. Deanichenko stubbornly stood his ground: the square, where a chain of police officers was exhibited, was not provided for as a place of the procession. Therefore, the demonstrators were not allowed there: "The square was never implied even once, he was not remembered at a meeting at the city hall with the organizers."
The colonel gave up
When the lawyer Makarov ended the questions (and there were several dozen of them), the lawyer of Masha Baronova Sergey Badamshin proceeded the interrogation of the key witness. He filed a petition for the announcement of documents from the materials of the case that was directly related to the testimony of Dinichenko’s witness in court. The colleague was supported by lawyer Vadim Kluvgant: “It is time to give interrogation a meaningful and substantial character. In our opinion, there are contradictions in the testimony of a witness in court and on a preliminary investigation. ”
In court, the correspondence of representatives of the Moscow City Hall with the organizers of the rally was announced, and documents regarding the administrative boundaries of the area.
“We have achieved the witness to emphasize that the swamp square includes the square. The Moscow government agreed to organize a rally on Bolotnaya Square, anyone from the Moscow government, giving this order, did not put any restrictions on the territory of this rally, ”the lawyer of Badamshin explained to The New Times. - Everything that happened later, in particular, the restriction of access to the square is the gag pure police officers. We pressed it with these documents, he finally answered our questions, and we found that the Swamp Square includes the square. ”
In addition, the colonel admitted that he was familiar with the scheme of the event, which was posted on the website of the Moscow Central Internal Affairs Directorate, and that this scheme did not correspond to the real state of affairs on May 6, 2012 (a rally plan on Bolotnaya Square on February 4, 2012 was duplicated). According to Sergei Badamshin, this suggests that ordinary people who could find out the scheme of the rally only from open sources were misleading distorted information on the official website of the Central Internal Affairs Directorate, from which it followed that the rally would be in the square -crossed police officer. “Today, in court, what we achieved all these days happened: after the carpet bombardment, we finally managed to find grain. We received all exhaustive information from this key witness, ”the lawyer stated.
When the testimony of Colonel Deanichenko, given to them during the investigation, was announced, it became obvious that, speaking in court, he did not remember much or did not want to remember much. So, for example, at the preliminary investigation, he said that he knew that in the scheme, published on the website of the Moscow Central Internal Affairs Directorate, the square was listed. In court, answering the question of lawyers why the wrong plan was published on the site, the witness stated that he was unknown.
Scandal
During the interrogation in the Investigative Committee, Deanichenko also said that the Moscow Central Internal Affairs Directorate had information about the desire of representatives of the opposition to arrange inconsistent actions. And in particular, that the organizers are going to defeat the tent camp. In connection with this information, the first serious scandal erupted in the process.
The lawyer Badamshin first interrogated Colonel Deanichenko on the announced documents. And then he suddenly asked him the question: “Is it possible to characterize your relationship with one of the organizers of the rally by Peter Tsarkov as comradely?”
“Yes,” Deanichenko nodded.
They joked in the hall.
"Did he give you information about the tents before the rally?" - continued the lawyer.
“He said that if someone will engage in tents in the square, then this is definitely not the organizers,” the witness answered.
“That is, during the interrogation, we found out that Tsarikov cooperated with law enforcement agencies,” the lawyer Badamshin commented on The New Times, Danichenko’s words in court. - Tsarkov at the rally was one of the organizers, was responsible for organizing the stage, for example. In the testimony of Deinichenko, the theme of tents sounded repeatedly, and in his certificate, following the results of the event on May 6, 2012, he also mentions tents. During interrogation on Wednesday, he did not want to specify what operational information he had, and today we left the definition of “operational information” and came to “trusting information” from Peter Tsarkov. According to the investigation, the state prosecution and witness of Deinichenko, the very presence of tents is a preparation for riots, although this absolutely does not comply with the law. "
The theme of tents and the “trust” information of Tsarkov, transferred by Colonel Deanichenko, continued other lawyers.
Lawyer Ruslan Chanidze, representing the interests of Yaroslav Belousov, asked the witness: “Tsarkov told you that the tents will be in the square, but they have nothing to do with it. They are he, Udaltsov, Razvozhaev, members of the "Left Front", so it was? "
Deanichenko replied: "As I understand it, he informed me of the provocations."
Lawyer Makarov asked a clarifying question: “Tsarkov said that the tents will be carried, or did something else mean? Did he warn you? "
“Tsarkov is a law -abiding citizen, I entrusted me with information about provocations, so carefully check this information,” Colonel Deinichenko advised lawyers.
Lawyer Makarov proposed to immediately ask Tsarkov, who was in the hall during the interrogation of the colonel. But Judge Nikishina disappointed the lawyer: Tsarkov could not be interviewed at this stage of the process, moreover, he would not be able to interrogate him in court at all, because he was present at the meetings. And witnesses are forbidden to be in court before they testify.
Tents for the Maidan
But Tsarkov still said his word. He jumped up and, turning to the trial, shouted, pointing to Deanichenko’s witness: “This man is a liar, he will sit! He did not even approach the organizers of the rally! "
The judge ordered the bailiffs to bring Tsarkov out of the hall for "improper behavior."
“This is a provocation from the prosecution,” said Peter Tsarkov The New Times. -I believe that the witness is lying, I know for sure that I did not communicate with him on May 6, 2012, respectively, I did not tell him any information about tents or any other information. The last time we talked with him at the city hall on May 4. And directly on May 6, none of the organizers - neither I, nor Sergey Davidis, nor Nadezhda Mityushkin - they did not see this person at all. Yesterday, during interrogation, he himself stated that he did not communicate with any of the organizers in Bolotnaya Square, but today for some reason he sharply changed his testimony. For some reason, he called my name and stated that I allegedly transmitted some information to him. I will sue him for slander. ”
Why is the question of whether or not in the swamp square of the tent is so important to protect? Indeed, there is not a word about this in the prosecution, which is brought by 12 defendants.
“Our defendant does not incriminate the blessings of tents for a rally, they are charged with participation in the riots. But according to the investigation, the mass riots did not just arise, they arose from the action of the alleged organizers, so the topic of tents is also important, ”lawyer Chanidze explained The New Times. - In the indictment in this case, the surnames of the organizers are not mentioned, unidentified persons are considered the organizers. But in another case, which is allocated from the so -called “maternal”, the organizers are named: these are Sergey Udaltsov, Leonid Razvoszhaev, Konstantin Lebedev, Givi Targamadze. ”
The eighth day of the process ended earlier than usual. The judge stated that “the defense crossed all the borders in connection with the interrogation of the witness,” and postponed the hearing until Tuesday on July 16. On this day, lawyers will again interrogate Colonel Deanichenko.
By the way, 450 witnesses of the prosecution appear in the indictment. There are witnesses for defense. And if each of them begins to interrogate with such addiction, then it is difficult to imagine how much the process can last.
However, the lawyer Badamshin is confident that the case of Deanichenko will be more likely an exception: “The judge will not allow the witnesses for so long. The moment will come when she drives the process forward. ”
