Court of Yuri Starovorov

On Friday, July 19, at 9:30 in the Nizhny Novgorod District Court of Nizhny Novgorod, the case of a member of the Executive Committee of the regional "other Russia" Yuri Old Belorov will begin to be considered on the merits. The activist is charged with part 1 of Article 318 of the Criminal Code (the use of non -hazardous violence in relation to a representative of the authorities). On the fabricated charges of attacking the ensign, riot police, Igor Lebedev during the Nizhny Novgorod Civil rally on September 15, 2012, the other Russia threatens up to five years in the colony. Judge Andrei Shutov, known for non -legal sentences for political matters, are considering the case.

Preliminary hearings were held on July 8. Staroverov and his lawyer Yuri Sidorov insisted on the return of the case to the prosecutor's office. They indicated that the reason for its excitement could only be a statement about a crime or a report on the discovery of one. Meanwhile, there is no other document in the case of Staroverov. Thus, the very initiation of the case against the activist is illegal. However, Shutov refused this petition.

Shutov also rejected the application for recognition of a number of materials of the case with unacceptable evidence. Finally, he refused to allow the human rights activist Stanislav Dmitrievsky and civil activist Sergei Kuznetsov as public defenders, although they have a notarized power of attorney to represent the interests of the activist. Thus, the judge directly violated the norms of the Code of Criminal Procedure, including part 2 of Article 49.

When the Old Believers tried to explain why he considers the initiation of the case illegal, Shutov noticed the activist: "You can’t even imagine how I understand what the case was painted for me."

All accusations are built on Lebedev’s phrase that Old Believers had caused his physical pain with his actions. Omonovets made this statement only a month and a half after the initiation of the case and the next day after the other Russia was declared the suspect.

When accelerating the September rally, Lebedev, despite the absence of any threat from the demonstrators, beat the activist Ekaterina Zaitseva and the Miter Ilya Ilya Nyaskovsky with a rubber club, and also threatened the member of Galier Yanalieva. Zaitseva, after hitting a club on the head, got to the hospital.

Old Believers, in order to protect Tyskovsky, stood opposite Lebedev and, gaining him with one hand behind his shoulders, took a few steps to him with him. The activist did not use violence to riot police.

The key witness of the prosecution is the 19-year-old activist of the “Young Guard of United Russia” Vera Ischyatullina, known for the participation in provocations against the Nizhny Novgorod opposition. Meanwhile, when accelerating the rally, she was on the opposite side of the square, where the action took place and could not see the events.

She later admitted that the testimony was together with the investigator of the Directorate of the Investigative Committee in the Nizhny Novgorod district of the city Sergey Malakhov. It was Malakhov who previously refused to initiate the case against Lebedev on the fact of the beating of Zaitseva and Myaskovsky.

In mid -June, eight witnesses filed a collective complaint with the regional prosecutor’s office against a systematic violation of Malakhov norms of the Code of Criminal Procedure during their interrogations.

Then, on the Internet, a half -hour film of Stanislav Vlasov “Pain” was posted, dedicated to total falsifications in the case of Staroverov.

Meanwhile, on July 9, the judge of the same Nizhny Novgorod District Court Maxim Yurin examined the complaint of Staroverov about the actions of the investigator of the district department of the Investigative Committee of Sergei Malakhov, who fabricated the case against the other Russia. In the fall of 2012, Malakhov conducted an audit at Lebedev’s statement about the attack, to whom he allegedly underwent from Old Belo and Zaitseva, and refused to initiate the case. Later, in the process of falsification of the case against the activist, the investigator introduced the materials of this audit to him, having made documents from them, which undeniably testifying to the innocence of the activist, and the demand of Staroverov to familiarize him with the verification refused.

Yurin recognized Malakhov’s refusal illegal and ordered him to introduce Staroverov to the verification materials. The other Russia and his lawyer will petition for their introduction to the case file when considering in court.
