The court sentenced the anti -fascist Kharchenko to 3.5 years of maximum security

The judge of the Zamoskvoretsky court Tatyana Kovalevskaya sentenced the anti -fascist Igor Kharchenko to 3 years 6 months of a maximum security colony, the New Gazeta reports . Kharchenko was found guilty in the case of the beating of two nationalists. Given the term that the convicted person spent in the Butyrka pre -trial detention center, he remained before the release for a year and a half. Kharchenko’s lawyers decide the question of whether they will appeal.

In addition, the court decided to partially satisfy the civil lawsuit claimed by the victims Vladlen Sumin in the amount of 880 thousand rubles. Kharchenko will have to pay the victim 300 thousand rubles.

Kharchenko was found guilty that he, as part of an organized group of unidentified persons on July 4, 2010, attacked Sumin and Vladimir Zhidousov, committed hooliganism and inflicted serious bodily harm to them. The victims in the case immediately after the attack could not identify anyone, but almost a year later they found photographs on the Internet, in which they identified in the attackers of Kharchenko and Denis Solopov. Solopov could not be involved in the case, since at the time of his attack he was not in the country. The FSB confirmed the authenticity of the departure in his passport. Kharchenko at the time of the fight spoke on a musical stage in the club, however, despite Alibi, he was arrested in June 2011.

Lawyer Kharchenko Mikhail Trepashkin considers the case completely fabricated, claiming that the prosecution is under construction only on the testimonies of the victims. According to him, Sumin and Jews confused in the testimony, reinforcing them with knowingly false details.

During the hearings, the judge rejected the majority of defense petitions. In particular, lawyers opposed the introduction to the case of the testimony of a witness who did not appear in the court at the stage of preliminary investigation. Also, lawyers demanded that objects that were not related to the accused be excluded from among the material evidence in the case.

An eyewitness to Fedorenko’s incident did not appear in court. The judge decided to announce his testimony given at the preliminary investigation. According to Fedorenko, interviewed only a year after the fight, he saw a group of young people who beat people lying on the ground. He also noticed that one of them had a gun from which he shot at the lying several times at point -blank. The witness did not remember the persons.

Trepashkin opposed Fedorenko’s testimony to the case file. The words about the shots are not confirmed by either the testimonies of the victims or the results of the ballistic examination, the lawyer noted.
