
The Russian authorities may have great difficulties with collecting real estate tax, since today it is not known who owns approximately 40% of objects in the country, and how to find out is not clear, the Vedomosti write, referring to the certificate prepared for the publication of the federal tax service.
To the cadastre, from where the tax authorities take data for calculating the tax, these data come from two sources: the Unified State Register of Copyrighters (USRP) and the Bureau of Technical Inventory (BTI). But the Unified State Register has existed only since 1998 and it does not take into account property rights that arose earlier, explains Anna Strezhnev’s KPMG lawyer in Russia and the CIS. And the information of the BTI, which were registered before 1998, cannot be automatically transferred to the cadastre. “The fact that the information about the rights is in BTI, the illusion. A copy of the title document is needed, but it, as a rule, is not,” explains Andrei Ivakin, director of the Department of the Ministry of Economic Development.
On objects where the owner is unknown, on average, Russia accounted for 39% of the entire tax base for calculating property tax for individuals in 2012, Vedomosti was told in the tax. In 18 regions, this indicator was more than 50%, for example, in the Smolensk region - about 77%, in the Arkhangelsk region - 75%, in the Kostroma region - 69%. In the Moscow region, the owners of 40% of the land plots are unknown, confirmed by the Director General of the Moscow Regional BTI Vladimir Denisov, the share of "ownerless" buildings less - about 20%.
According to the calculations of the head of the analytical portal IRn.ru, Oleg Rephenko, due to 40% of "unaccounted" owners, regional budgets may not receive 45 billion rubles from individuals annually.
The Ministry of Economic Development of Development proposes the following solution to the problem: if, before a certain date, for example, until 2020, the owner has not registered his rights, the municipality has the right to launch the procedure for recognizing such real estate as an ownerless. At the same time, the owners will be given one year to declare their rights to unregistered real estate, and then a court decision.
As previously reported, the law on the introduction of real estate tax can be adopted next year. In this case, he can enter into force no earlier than 2015.
