
On October 16, in the Kirov Regional Court, the appeal in the Kirovles case against Alexei Navalny and Pyotr Officerov begins.
It is worth recalling that on July 18, the Lenin court of Kirov sentenced Alexei Navalny to five years in a general regime colony, his companion Peter Officers received four years in prison. In addition, both defendants were sentenced to a fine of 500 thousand rubles. According to the prosecution, Navalny with an officer stole the products of the Kirov company Kirovles in the amount of over 16 million rubles. After the announcement of the sentence, Navalny was taken into custody in the courtroom, but the next day was released at the request of the prosecutor for a recognizance not to participate in the election of the Moscow Mayor.
Having familiarized himself with the trial of the court session, on September 13, Navalny’s lawyer Sergei Kobelev sent the comments on 89 sheets to the protocol, which were made, according to the defense. On September 27, the Lenin court of Kirov examined these comments and sent his decision to the regional court and lawyers by mail.
On the eve of the beginning of the appeal, Kobelev received his copy of the decision. “The decision on the consideration of comments on the protocol was presented to me today in the Lenin court. The remarks are partially satisfied, most of the rejected, ”RIA Novosti told the lawyer. According to him, the decree says that "despite the assertion of the defense, the Code of Criminal Procedure does not provide for the literal reflection in the protocol of the entire course of the court session."
When asked how this document may affect the consideration of a complaint about the verdict on October 16, Kobelev noted that the protocol is an important procedural document. “This, of course, affects. But decisions can be expected, regardless of the satisfaction of the comments, ”the lawyer noted.
Alexey Navalny himself does not believe in an acquittal. On the eve of his departure to Kirov, he gave a detailed interview with the Moscow Komsomol member, in which, among other things, to the question of participating in the upcoming elections in the Moscow City Duma, Navalny answered: “Personally, I believe that the Kirov court will deprive me of this opportunity: they will give me a real or conditional period, but will not justify. However, in the campaign I will still take part. ”
