
The judge of the Reutov Garrison Military Court in the suburbs, Artem Filimonov, sentenced Lieutenant Sergei Gruzdev by the year of a colony-settlement for an attack on the carrier soldier Andrei Litovka, as a result of which the victim had to remove the spleen. This was reported by the open news agency with reference to the head of the human rights NPO "Shield and Sword" by Alexei Glukhov, who represented the interests of Lithuania at the initiative of the Agora Association. The officer was found guilty under part 3 of Article 286 of the Criminal Code (abuse of authority with the use of violence and causing grave consequences).
Gruzdev was the commander of a communication platoon of the automobile detachment of the 179th rescue center of the Ministry of Emergencies, located in Noginsk. In this center, a 20-year-old private Lithuanian driver served as an electrical driver.
On August 15, during a planned audit of the fleet, Lithuania handed over to that day a march on the march and forgot to signal. For this, Gruzdev, opening the door of the truck, hit the soldier in the stomach. With one blow, he repulsed the spleen, which had to be removed.
The lieutenant wrote a confession and partially compensated the victim to the damage. On this basis, the state prosecutor asked the court to re -qualify Gruzdev the category of crime with grave in medium gravity and impose him a punishment below the lower limit provided for in the Criminal Code. The sanction under Part 3 of Article 286 is from 3 to 10 years of the colony with deprivation of the right to occupy certain positions. The prosecutor requested the year of the colony-settlement without deprivation of such a right.
Lithuanian and Glukhov, on the contrary, insisted on a more strict punishment of the lieutenant.
Gruzdev himself in the last word pleaded guilty, but asked him to appoint him a punishment not related to deprivation of liberty, "so as not to replenish the ranks of prisoners in the Russian Federation."
As a result, Filimonov appointed the officer exactly the punishment that the prosecutor requested.
Lithuania and Glukhov announced their intention to appeal the verdict in a higher instance.
