The HRC asks the Prosecutor General to suspend the courts against NPOs until the Constitutional Court

The Human Rights Council appealed to the Prosecutor General Yuri Chaika with a request to suspend the trials of lawsuits against NPOs before the Constitutional Court of the decision on the compliance of the Constitution of the Law on "Foreign Agents". An appeal signed by the head of the HRC Mikhail Fedotov is published on the Council website.

The document notes that the courts are currently considering a number of civil claims of the prosecutor's office to register NPOs as a “foreign agent”. In particular, such claims were filed against the anti -discrimination center "Memorial" in St. Petersburg, the ROO Union "Women Don" in Novocherkassk. Similar processes are in Moscow and other regions.

At the same time, the circulation is noted, the Constitutional Court considers the petitions of several Russian NPOs to verify the relevant provisions of the law. "It is obvious that the decision of the Constitutional Court, whatever it may be, will be mandatory both for the Federal Assembly and for all law enforcement agencies, indicating them with the legal positions that should be guided by the resolution of specific cases," the document says.

On the basis of a number of articles of the Civil Procedure Code, the State Prosecutor General asks the Prosecutor General to initiate the suspension of proceedings in relation to NGOs before the decision of the KS. Fedotov also invites Seagull to joint work on the adjustment of the NPO law.

The head of the HRC recalls that the seagull himself spoke of the need to clarify the concept of "political activity" in the Law on NGOs. In addition, according to Fedotov, President Vladimir Putin spoke about this problem at a meeting with HRC members on September 4.

On August 30, the KS received a complaint of Ombudsman Vladimir Lukin against the law on "foreign agents". “The provisions of the document, which are given the definitions of“ foreign agent ”and“ political activity ”are politically and legally unchanged,” summed up the essence of his claims to the Lukin law.

On August 23, the Constitutional Court registered a complaint of representatives of the Kostroma Center for Support for Public Initiatives Foundation . Representatives of the Foundation Ramil Akhmetgaliev, Yuri Kostanov, Pavel Chikov and Ilya Shablinsky sent a complaint on August 13. On the eve of the Sverdlovsk District Court of the city, he upheated fines of 300 and 100 thousand rubles, previously imposed on the organization and its executive director Alexander Zamaryanov by the magistrate. For such cases, the district court is the highest authority, and after its decision, the right to appeal to the Constitutional Court arises.

In the complaint, representatives of the Center argue that the Law on NPOs violates the five articles of the Constitution at once - 19 (equality before the law), 29 (freedom of speech), 30 (the right to unite), 32 (the right to participate in the management of state affairs) and 51 (the right to not testify against itself).
