The Tver Regional Court returned the case of rural teacher Ilya Farber to the Ostashkovsky city court, RAPSI reports with reference to the press secretary of the regional court, Nina Tumanova. The City Court should consider the issue of adding additional documents to the case file.
“The court did not consider all the appeals for the verdict, the case was returned to the Ostashkovsky court due to the fact that additional complaints were received: the appeal from another lawyer, and Farber himself filed comments on the trial protocol. Only the city court can decide, add these complaints to the case file or leave everything as it is,” said Tumanova. The terms of consideration of complaints will be set by the City Court.
During the consideration of these documents in the Ostashkovsky court, Farber will be under arrest. “He tried to raise the question of changing the preventive measure, but since formally the court hearing was not open due to the complaints received, he had no reason to submit petitions,” Tumanova said.
After the materials from the city court, together with the complaint of the protection of the regional court, will also consider the submission of the city prosecutor Ostashkov Alexander Tikhomirov, who asked to remove one of the accusations from the teacher.
“In general, the judgment is in full swing, and now the ball is sent back to the gate of the Ostashkovsky city court,” Farber Peter said on Facebook.
On November 2, Farber refused the services of lawyers . The statement by Ilya Farber, published by his son, says that this decision is not related to material problems, but is related to the understanding that "work and participation in the court hearings of professional lawyers does not affect the court decision." According to Farber, his defenders, including a lawyer appointed by the court, "completely and comprehensively, convincingly and accessible for all mind" proved his innocence "on all points of the charges." This, as Farber emphasized, had no influence on the decision adopted by the court.
On August 1, the Ostashkovsky City Courtsentenced Farber to the age of seven and one month of a maximum security colony. A fine of 3.1 million rubles was imposed on it. The judge considered the teacher guilty under Part 1 of Article 285 (abuse of authority), part 3 and paragraph "in" Part 5 of Article 290 of the Criminal Code (receiving a large -scale bribe for illegal actions). Farber did not find himself guilty. This was already the second sentence in his case. Earlier, the Supreme Court canceled the previous decision - eight years of a colony with a fine of 3.2 million rubles.
In early September, President Vladimir Putin called the sentence to Farber with a flagrant case . At the same time, the head of state noted, "the judge himself chooses a certain decision," and "there may be mistakes." “These are issues of improving the judicial system,” Putin summed up. “But this is not a question that it is not good, it needs to be broken all over.”
On September 17, the prosecutor Tikhomirov appealed to the Ostashkovsky City Court with a request to restore the deadline for appealing the sentence to Farber . On September 24, this petition was satisfied. After that, the prosecutor sent an appeal to the Tver Regional Court with a request to stop the pursuit of Farber under the 285th article , and according to the 290th to say him to five years of strict regime with a fine.
