The scientific editor of the Internet magazine "Open Text" Igor Nesterov noted that at a rally on September 15, the police dispersed the demonstrators with rubber batons for the first time in many years. He regarded the actions of the police as a pre -planned provocation in order to take revenge on the opposition for the sequence of defending their requirements.

Witnesses also drew attention to numerous procedural violations of the legislation by the investigator of the Directorate of the Investigative Committee of the Nizhny Novgorod District of the city Sergey Malakhov , who led the case of Staroverov. Thus, the civil activist Evgenia Kaminskaya accused Malakhova of psychological pressure, a sentence of leading questions and distorting her testimony. In addition, the activist noted, the investigator refused to attach to the case file the scheme of the square, where the rally was held. The activist added that she recorded an interrogation on her phone and is ready to present to the audio court.

The defense of Staroverovov petitioned for the demand from the Investigative Committee, the study and introduction to the materials of the case of verification materials No. 733 SK-2012, which undeniably prove the innocence of the activist, as well as the fact of falsification of the case against him. Interrogations of witnesses of defense began on December 5. Then the testimonies were given by seven activists , including Ekaterina Zaitseva, who were beaten by the Ensign Lebedeva, Ekaterina Zaitseva and civil activist Ilya Myaskovsky. They also refuted the accusation against Staroverov, noting at the same time that OMON applied unjustified violence to the rally participants. Witnesses Vladimir Kravtsov and Vladimir Frolov stated, in particular, in the same way as the Old Believers, they tied Lebedev’s movements, preventing him from impacts with a club. Zaitseva said that it was she who removed the helmet from the riot police so that the journalists record his face for subsequent identification.

Witnesses, questioned on Thursday, also accused the authorities of provocations, and investigator Malakhov - of the factory of the case.
