
The Presidium of the Supreme Court softened the sentences to two members of the autonomous military terrorist organization - the leader of the group Ivan Astashin, as well as Bogdan Golonkov. This was reported by RAPSI. Astashin was reduced from 12 years to 6 months to 9 years 9 months of strict regime, and also removed an additional punishment from him in the form of restriction of freedom. The term appointed to Golonkov was left the same - 9 and a half years - however, the restriction of freedom was removed from it.
The idea of the mitigation of the sentence by the convict was introduced by the deputy prosecutor’s prosecutor Sergei Buksman. He pointed out the illegality of additional punishment, since his appointment to a minor is not provided. In addition, he asked the court to stop the criminal prosecution of Astashin and Golonkov on a number of episodes after the statute of limitations. The court granted the presentation of the boxman partially, disagreing to reduce the term to Golonkov.
Astashin himself asked to return the case for a revision, but not to the Moscow City Court, where hearings were held, but to the Moscow Regional Court. The lawyers of the convicts in their complaints stated that the actions of nationalists in any case did not cause significant damage. They also insisted that Article 205 of the Criminal Code (terrorism) was imputed by their client unreasonably. The court did not take into account the statements of convicts and protection.
In April 2012, the judge of the Moscow City Court Pavel Melekhin sentenced 10 members of the ABTO to punishment from three years conditionally to 13 years of strict regime for a series of terrorist attacks. The defendants were found guilty of a number of articles of the Criminal Code: terrorism, illegal production of weapons and explosives, the destruction of other people's property, humiliation of honor and dignity of people on the basis of race and nationality.
As stated in the case file, ABTO members arranged a series of explosions and arson, including the police and the FSB reception. The most strict punishment was the leader of ABTO Astashin, for a year less gave Kirill Krasavikov. Yaroslav Rudny was sentenced to six years in a colony. During the investigation, he was under the subscription about the wonness, and the prosecutor asked for a conditional term for him. However, the court did not agree with the position of the prosecution, and Rudny was taken into custody in the courtroom.
Astashin Ksenia, the court, gave eight years of general regime. A conditional sentence - three years with a four -year trial - received only one defendant - Igor Zaitsev.
In the form of an additional punishment, the court appointed a number of ABTO members several years of restriction of freedom. In addition, over 1.5 million rubles were recovered from the convicts as compensation for the harm caused to the victims.
In July 2012, the Supreme Court softened the punishment of several defendants in the case. Astashin was reduced by six months - up to 12 years 6 months. The halter and Andrei Markhai, sentenced to 10 years, achieved a noticeable mitigation - they reduced the terms to both years. Maxim Ivanov was reduced from 10 years to eight.
In June 2013, the Moscow City Court banned the ABTO , recognizing that the unregistered community since March 2009 has led terrorist activities. The prosecutor of Moscow Sergei Kudeneev filed a claim for the ban on ABTO. Astashin’s lawyer Igor Popovsky at the meeting stated that the organization had neither the charter nor membership. From this, he concluded, it follows that the ABTO as such did not exist, and therefore the proceedings must be terminated. Nevertheless, the court did not accept his arguments.
