
The Decree of the State Duma on the amnesty in connection with the 20th anniversary of the Constitution is officially published on the Internet portal of legal information on Wednesday evening. Thus, it entered into force. A decree on the procedure for applying amnesty has also been published .
Pavel Krasheninnikov, the head of the State Duma Committee on Legislation, confirmed that by law the publication of documents adopted by the State Duma on this portal, along with the Russian Newspaper and the Parliamentary newspaper, is official.
The decision to release the amnesty of prisoners is made by the head of the correctional institution in which they are serving their sentences. The decision on the use of amnesty in relation to the under investigation and defendants is made respectively by the investigating authorities or the court.
Earlier on Wednesday, the State Duma adopted in the second and final reading the presidential draft decree on amnesty . The Committee on Civil, Criminal, Arbitration and Procedure Legislation recommended that most amendments to the project reject . In total, deputies were offered over 50 adjustments.
In particular, the committee rejected the amendment, which provided for the spread of amnesty to the organizers of the riots. Accordingly, the persecution of the coordinator of the Left Front Sergey Udaltsov and his assistant Leonid Razvozzhaev, who are charged with part 1 of Article 212 of the Criminal Code, will continue.
At the same time, the Committee supported the amendment, which extends an amnesty not only to convicts, but also to the under investigation and defendants, including in the affairs of the articles on riots (part 2 and 3 of Article 212 of the Criminal Code), hooliganism and violation of the rules of the road and the operation of vehicles.
Thus, three defendants in the “swamp business” will be released without trial: Vladimir Akimenkov, Leonid Kovyazin and Dmitry Rukavishnikov. In addition, the persecution of five more will be stopped: Maria Baronova, who is under subscription about the lower room, Nikolai Caucasian, placed under house arrest, political emigrants of Anastasia Rybachenko, as well as those released for the unproven charge of Oleg Arkhipenkov and Fedor Bakhov. Four of the defendants - Akimenkov, Baronov, Caucasian and Kovyazin - are already under trial. Their cases are considered within the framework of the "Twelve process".
In addition, all the persons involved in the Arctic Sunrise case will be exempted from criminal prosecution. Pussy Riot participants Nadezhda Tolokonnikova and Maria Alekhina should also be released under amnesty. Tolokonnikova’s husband Petr Verzilov said on Wednesday that the IK-2 administration in Nizhny Novgorod and KTB-1 in Krasnoyarsk are ready to free political prisoners "immediately and without a red tape-probably tomorrow."
At the same time, part 2 of Article 133 (coercion to sexual acts), part 3-5 of Article 205 (undergoing training in order to carry out terrorist activities and a terrorist organization and participation in them) and part 3 of Article 286 (exceeding the violence or the threat of its use) are excluded from the list of crimes. Human rights activists insisted on the exclusion of the latter of these compositions. They pointed out that otherwise the police involved in the matters of torture would avoid responsibility.
