The judge of the Tuapse City Court of the Kuban Igor Milinchuk replaced the activist of the ecological shift in the North Caucasus Evgeny Vitishko, a conditional term in a three-year imprisonment in a colony-settlement. This was reported on Twitter by Ecologist Lawyer Alexander Popkov. The criminal-executive inspection insisted on tightening the punishment to the activist. “All defense arguments have been reached in favor of the prosecution,” the lawyer commented on the decision.
Before the decision enters into legal force, Vitishko will remain free . He has 10 days to appeal.
Initially, the consideration of the Vitishko case was scheduled for November 28, but then the trial was postponed to prepare the protection position . The process began on December 19 and continued the next day. A number of defense witnesses were questioned, confirmed that the activist did not violate the sentence of sentence.
On November 6, Vitishko, sentenced to three years on charges of damage to the fence in the country of the Kuban governor Alexander Tkachev, issued another warning "about the violation of the regime of serving the sentence", for not notifying the penitentiary and executive inspection about traveling beyond the Tuapsinsky district.
On November 4, the police twice detained Vitishko when he returned from Krasnodar in Tuapse. The first time the traffic police inspectors said that the driver of the car on which the activist was traveling was the culprit of the accident and disappeared from the scene of the incident. Under this pretext, they searched for an hour for an hour.
For the second time, under a similar pretext, the traffic police detained in the village of Dzhubga. The trial also took about an hour. Then the employees of the local police department accused Vitishko of the fact that he was not at home in the previous night, thereby violating the norms of the Criminal Executive Code. In the service car, they accompanied the car's car to Tuapse. There, the police handed over the eco -defender to the TSPE operatives.
The operatives demanded from Vitishko explanations about what happened, but the activist refused the explanation. After dactyloscopy, he was released.
The verdict of the eco -defender was sentenced by the Tuapse district court on June 20, 2012. Together with Vitishko, his colleague in Ekovakhta was condemned - Surena Gazaryan. Later, a new business was opened against Gazaryan, after which he fled from Russia and received a political officer in Estonia . In the future, the activist moved to Georgia.
In October, the deputy chairman of the Supreme Court Anatoly Tolkachenko abolished the sentence to Gazaryan and Vitishko and decided to initiate supervisory production on the presidium of the Krasnodar Chief of Kraisud. In the resolution, Tolkachenko indicated that the motives of the actions of eco -activists, named in the sentence by the hooligan, were not actually established. In addition, the court did not consider how legitimate the construction of the fence, allegedly damaged by ecologists, was.
However, on Wednesday, the Presidium of the Chinesud rejected the supervisory complaint , evaluating the decision of Tolkachenko as unreasonable. “In fact, the regional court recognized the decision of a higher court illegal,” Gazaryan noted in this regard. “It is inexplicably from the point of view of the law, but it is expected: in the territory of the region, the judiciary belongs to the governor Tkachev, like everyone else.”
