
The Chairman of the TFR, Alexander Bastrykin, sent to the highest qualification collegium of judges (VKKS) an idea of the consent of consent to initiate a criminal case against judge Irina Baranova. It is reported by Kommersant. The chairman of the 5th court of the Arbitration Court of Moscow Baranov and one of her subordinates Julia Bespalova are suspected of assisting the raiders.
The audit against Baranova was carried out as part of an investigation into a criminal case of the raider seizure of house No. 3 in accordance with Gogolevsky Boulevard in Moscow. According to investigators, the judge helped the former owners of the building to businessmen Mikhail Chernov and Mikhail Balakirev achieve a court decision on the return of the house. In particular, she bowed Chernov to the giving bribe of Bespalova, who was considering the case.
Baranova herself received from a businessman about more than 100 thousand euros and four thousand dollars, the publication reports. In addition, she instructed Chernova what to say in the process and what documents to provide the court so that the decision looked legal. Negotiations were conducted on the phone, which allowed the investigation to calculate Baranov.
The fact that SKD suspects judges Baranov and Bespalov of involvement in the raider seizure of the building became known in February 2013. It was reported that in 2010 Chernov appealed to the Arbitration Court with a lawsuit to recognize the previously previously concluded transaction on the sale of the house. In confirmation of his position, the businessman provided court with falsified documents. In November 2011, Judge Bespalova satisfied Chernov’s claim.
In September 2013, Chernov and Balakirev were found guilty of fraud and an attempt to legalize property, the publication reports. They were condemned for nine and seven years in prison, respectively. Businessmen appealed the verdict.
According to the publication in the Arbitration Court, Irina Baranova is still a "acting judge", but does not consider the case. Whether a criminal case will be instituted against Bespalova, the publication does not report.
