I’m not a lawyer, but for 25 years I have been working as a professional photo and video reporter, a multimedia editor and a video director. Therefore, I will talk about what is closer to me, especially since it was reporting shooting that became the most important evidence in this matter. I am sorry that I can’t use technical means in order to clearly demonstrate my conclusions and arguments. But since the rules of the trial are so archaic, you will have to use exclusively oral speech.

This business is very indicative not only in terms of social significance. Probably for the first time in the case file there is so much visual information. As a result of the work done on the collection of a huge volume of video recordings, we could count on the creation of a detailed, chronometrically accurate picture of events, which reflects their sequence, the actions of all sides and participants, and most importantly - the logic and interconnection of individual episodes and actions. Only in this way, relying on the video, could the court establish an objective picture of what happened, the motives and circumstances of the actions of all the defendants in the case .

What learned from the assembled video collected?

It is quite obvious that all videos are not presented on the original media. In this case, we would deal with special memory cards used in photo and video cameras (CompactFlash, SD, Memory Stick, etc.) or video cassettes. And these are not mentioned anywhere in the protocols. In the process of withdrawal of materials, the investigation did not reflect whether the presence of the initial media and the reconciliation of the identity of the resulting material with the source was carried out.

On the contrary, the materials seized at the Moscow-24 GIT 09/26/2012 on the DVD-R DVD-R DVD-R No. ZE3264-DVD-347C1 347C1 (and as a result attached to the disk business-DVD+R No.papa30pl251938792), are five video files (VTS_01_1_1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 --1 01_5) DVD-Video format (format .vob). Four of them have the same size and duration (14 min. 24 sec.). In this form, they cannot be a direct video of the video. This format is used for the final recording of films for comfortable viewing on computers and TVs. So, this is already made by someone compilation. Which is confirmed by a video sector representing a set of individual, not interconnected episodes. The same can be said about the four files seized from OJSC Channel One (VTS_01_1 - VTS_01_4 files attached to the DVD+R DVD business (volume 28, ld 11, 46, 81) and others.

During the court hearing, I already noted that, for example, the VTS_01_1 file from the DVD-R DVD-R disc No. PAPA30PL251938792 contains a minimum of 68 installation joints, and the lighting on neighboring recording fragments indicates a different time of the day. All these claims can be attributed to almost all video materials.

In general, only one video file is a whole continuous, consistent recording of events-a record of the Minaevlive broadcast, since it is a record of continuous online broadcasting. Without questioning the attitude of fragments to the events of May 6, in all other cases it would seem logical to establish a connection between fragments, their sequence, chronology, identical episodes. The consequence has not been concerned about this.

Instead of a serious analysis and careful attitude to the existing material, the investigation rewrites them, changing the already charmingly recorded files. At the same time, apparently, he proudly notes in the protocols: "Without involving a specialist." But the more complicated manipulations with such difficult information technology as a modern video, the more important it is qualifications and professional training.

We observed the results of the lack of this qualification in court: some of the views viewed at meetings from July 17 to August 13, 2013 were simply not launched or periodically hung on the computer provided by the court. The VTS_01_5 file from the DVD+R Papa30PL251938792 disk did not open at all, as well as the entire DVD+R Papa30PL251342472 disc.

And the point here is not at all in the accidental disk. It is significant that the biggest problems arose when viewing small excerpts of the video from the disks, which collect episodes for each of the defendants (in court they were demonstrated on August 7, 8 and 13). With these files, the largest amount of actions was performed (rewriting, cutting). When trying to play in court, they either were not played at all, or were reproduced by jumps, with delays, hanging, at a slow or accelerated pace. Which practically made an adequate assessment of the information contained in them.

The secret of these effects is simple. Consider the file "RKDQM0R8DLM segment from 01 minutes. 09 sec. 01 min. 20 sec. " From the CD-RW disk No. HLD625RK30224702B0Z (where Barabanov episodes are collected). The initial file "RKDQM0R8DLM", located on the DVD+R No. PAPA30PL251756322 disk, has the following parameters: form- .Mpeg-4, bitrate- 3000 kb/s. The fragment “Rkdqm0r8dlm segment from 01 min. 09 sec. 01 min. 20 sec. " - such: format - .Avi, bitrate - 35300 kb/s. Those. The transformed file is recorded in a completely different format, with a stream (bitrate) more than 10 times higher than the original. Such an artificial “improving quality” does not add anything to the image (which was, it will remain), but only makes it difficult to play the video. The average level of the laptop should not cope with such a crazy huge bitrate and normally reproduce this video.

The source file “346_0044_02” has: format - .Mpeg -4, bitrate - 19900 KB/s, speed - 50 frames/second. Made by Gurkin (investigator. - Ed.) Fragment of the file: format - .RMVB (this exotic format is generally almost unknown in household practice, is not supported by many players programs, and why it was repeatedly chosen by the investigator for recording - it is unclear), bitrate - 2786 KB/s, 30 frames/sec. Those. All technical parameters of the initial and obtained video diverge. As a result of such transformations, not only the quality or possibility of reproduction are lost, individual personnel may disappear that are so important for the forensic assessment of the actions of the defendants and their environment. Especially considering that these fragments in most cases have a duration of 3-7 seconds and reflect almost elusive fleeting actions for the eye.

And there are many such examples. It is characteristic that when processing the video, the investigator used (volume No. 28 ld 191, etc.) Avidemux 2.5 program - a free application with an open code. Those. The program does not have the official owner of the manufacturer, it spreads through many amateur resources, exists in a lot of various versions and does not give any guarantees.

But technical flaws are only part of the problem. Working with visual materials, the investigation allowed itself (and the accusation recognized this permissible) strange manipulations with their procedural status . It is the final, obtained as a result of these illiterate transformations of the diabetes of diabetes, are recognized as material evidence in the protocols. That is, the material, flat, small objects are made most likely in China, acquired unknown when, by whom, and to the events of May 6, 2012 in Bolotnaya have absolutely nothing to do. At the same time, the information itself, the video and photographs, originally obtained by the investigation, are present in the case only in the form of “inspection protocols”. It turns out a legal paradox: the most important information contained on the records itself has no procedural status. And the plastic discs and the words of the person who once retelled the initial video that had seen, have no evidence-based values ​​have the status. Moreover, this person, investigator Gurkin (as the lawyer Keokant noted in his petition rejected by the court on July 18, 2013) in this case performed in three qualities at once: the investigator (while grossly violating the Code of Criminal Procedure of the Russian Federation); a person identifying other persons (in the video); And the face gives evidence, moreover, to himself (since he retells in his free and evaluative form what he dreamed of in the video). This at least requires the exclusion of all the inspection protocols from the consideration by the court.

Moreover: all the inspections of the video from the volumes of case No. 27-29 are based on the inspections of those various carriers that were obtained by the investigation in the process of seizure-flash drives, external discs, CDs. But in the case they are absent. And the set of identical DVD+r disks was attached to the case, on which the consequence of all video materials were rewritten, which have already been described by me illiterate actions. As for the location of the examined carriers themselves, it is only said that they are “packed in separate paper envelopes equipped with a tag with an explanatory inscription” (Volume No. 27, ld 81, volume No. 28, ld 145, 152, volume No. 29, ld 7, 33, etc.). So what did we look in court: what the investigator Gurkin saw and described, or the result of his illiterate actions? If the last, then it is more reasonable to trust your eyes, and not his descriptions of what we did not see.

However, in order to evaluate the degree of evidence of materials on my, in particular, client, I will give some quotes from the inspection protocol of the video minevlive from the DVD+R PAPA30PL251756361 disk, which, as I have noted, is the only source that gives an idea of ​​the general course of events. At the same time, let's see how the charge uses these protocols . The indictment provides a quote from the protocol:

“On a fragment of video recordings from 02 hours 56 minutes. 30 sec. Until 02 hours 59 min. 30 sec. A group of citizens breaking through the cordon of police officers is captured. Among the indicated group of people is A.N. Barabanov ".

In the protocol itself in the same place, we read:

“On a fragment of video recordings from 02 hours 56 minutes. 30 sec. Until 02 hours 59 min. 30 sec. A group of citizens breaking through the cordon of police officers is captured. In particular, among the groups of people there is a person in a black T -shirt with a white pattern on his chest, European appearance, thin physique, with black long hair. ” (Volume No. 27 ld 4)

Firstly, no drum and generally similar to him in this period of time on the video are simply observed. Yes, drums and could not be there at that time in accordance with the testimony of several witnesses and Barabanov himself, who neither a consequence nor the prosecution refute. Because this moment took place much earlier than the episode. But the accusation not only rewrites this obvious mistake (it happens, confuses the person) of the investigator, but also clarifies, performing his own illegal “identification”: a person in a black T -shirt is precisely drums! For what? And just in case and for the sophistication of persuasiveness.

Further in the protocol: "The crowd is assembled along the cordon line, attempts to break through the cordon on the roadway begin." (Volume No. 27 ld 4)

There is a clear injection of the indictment, neglect of facts. The income columns of the demonstrators are already standing on the roadway of the Small Stone Bridge, this is part of their agreed route. Where else is they “on the roadway” to break through?

“At 03 hours 19 min. 41 sec. In front of this group, A. Dukhanin runs out And he throws an unidentified subject towards police officers, after which he runs into the crowd. At the same time, a burning pyrotechnic product falls on the asphalt in the crowd. ”

The girl, named by Dukhanina (neither recognition of the video, nor any examination, was conducted), which woven with his hand towards the police, the investigator notes. And the fact that the burning fire is flying into it from the side of the police line (which is a gross violation of the police law), is silent.

“From 03 hours 19 min. up to 03 hours 24 min. A group of citizens moved metal barriers to a cordon and made an attempt with the help of them to push away a police cordon. At the same time, stones, pieces of asphalt fly from the crowd to police officers. ”

There are several distortions at once:

1) The thesis about squeezing by the police demonstrators with the help of the blurations more than once appears in the charges, migrating there from the inspection protocols. This episode appears in accusations to Lutskevich and Polikhovich. However, we did not see a single contact of the indicated blockage with the body of the employees on any record. They were simply brought and put together and the police in the place where the police for inexplicable reasons cruelly crashed into standing people. I do not know how to object to this false statement at all if the eyes of the investigator and prosecutors are able to see what there simply is not on the records. This is either a matter of mental sanity or frank falsification of evidence.

2) the distant upper point of the shooting, a significant distance, the small plan and the low quality of the recording physically do not allow us to consider what flies where. After all, the investigator did not consider what the girl had specifically left in the previous episode. How does he know about flying stones? This is only an unfounded assumption or again outright lie.

In the same style, all the inspections of the video are drawn up. But since the accusation considered it possible to rely on such a subjective interpretation, I consider myself entitled to describe in my own way what I have seen in the video recordings of Minaevlive.

First of all, it is possible to set objective time on it, although there is no time code on the record itself. But at 0:26:55, a watch in the studio showing 15:26:50, i.e. The time on the video - "Round", 00:00:00 video records corresponds to 15:00 Moscow time.

Speaking in the debate, the accusation claimed that "on the time code for 2 hours 21 minutes, the record indicates a free turn for demonstrators to the embankment, towards the scene." This is a manipulation. At this moment, the camera shows only a fragment of the embankment much further than the turn. The crowd there really stands less often, and people go in a small stream towards the stage. But some witnesses already claimed that they were able to go there. These are those who came before the main column. And those who went in its most right rows. Why do so few people go on the indicated frame? But because the real picture of the descent from the small stone bridge is shown a little earlier - at 2 hours 17 minutes. 30 sec. On this frame it is clear that the entire width of the descent from the bridge is filled with a dense mass of people who rested on a cordon crossing the street. Serafimovich near the "drummer". And the crowds who are in the thick of the crowd can not see either the passage or the opportunity to turn. This situation laid the foundation for that toll, which many witnesses of defense and even accusations spoke of, as Witness Vanyukhin in court on October 6: “The tank was formed because they pressed the rear on the front. It was after a sedentary strike. I don’t know at all if citizens wanted to break through. ”

Then we see the following (I bring already counted, the real time of events):

На основании этой пятичасовой записи можно сделать один уверенный вывод: демонстранты, находясь на набережной, ни разу не предпринимают активных действий против полиции, не пытаются никуда прорваться и ни на кого нападать. Полиция периодически атакует стоящих людей, сдавливая их, прижимая к воде или естественным преградам , применяя дубинки и грубую физическую силу. Это иногда вызывает панику, иногда - вполне естественную эмоциональную реакцию негодования, сопротивление сдавливанию и прижиманию к берегу канала, попытки освободиться в опасной для жизни ситуации.

Обвинение в прениях утверждало, что «более двух часов на этой записи мы наблюдаем активные противоправные действия митингующих». Я утверждаю, что на протяжении двух часов мы наблюдаем классическую операцию по зачистке территории полицией. Только территория эта запружена десятками тысяч людей, не понимающих, что происходит, и уверенных, что пришли на законный митинг. А операция проводится столь жестоко, неуклюже и непоследовательно, что это регулярно создает опасность для жизни и здоровья пришедших на мирный митинг граждан.

Из всего изучения визуальных доказательств обвинения можно сделать лишь один вывод: следствие, совершив большую работу по сбору визуальной информации, совершенно неграмотно, безответственно, с нарушениями УПК подошло к обработке и осмыслению важнейших материалов дела. А обвинение использует полученные неубедительные данные с заведомо обвинительным уклоном. Поэтому я прошу не доверять вышеуказанному протоколу из Тома 27, л.д. 1-82.

Столь же невнятно использует обвинение видеозаписи в отношении моей подзащитной Александры Наумовой (Духаниной). На диске CD-RW hld625pk30224707b06, просмотренном в суде 7 августа 2013 г., собраны эпизоды, имеющие якобы отношение к моей подзащитной. На диске 15 фрагментов.

Прежде всего, как появились эти фрагменты. В соответствии с протоколом осмотра от 17 ноября 2012 г. (Том 28 л.д. 182-192) за два часа (по протоколу с 11:40 до 13:40) были осмотрены 10 источников видео суммарной длительностью около 6,5 часов. Из них вырезаны 15 фрагментов и записаны на отдельные диски. Также сделаны 43 скриншота (стоп-кадра) для фототаблицы. На них при помощи не указанной в протоколе программы (возможно, Photoshop) сделаны пометки в виде рамок на фигурах отдельных людей. Кроме того, при помощи неизвестной программы сделаны макеты страниц для последующей распечатки, на которых определенным образом расположены данные изображения, между ними нарисованы указывающие стрелки и поясняющие записи. После этого страницы распечатаны на принтере. Кроме того, составлено подробное описание вырезанных фрагментов, написан и распечатан протокол на 11 страницах. Я опытнейший профессионал, но даже техническую часть работы (без осмотра 6,5 часов видео) не смог бы сделать за два часа.

Под протоколом стоят подписи двух понятых, имена которых («Медведев Дмитрий Витальевич из города Любеhц И » и «Мальцев Анто В Олегович») со всеми явными ошибками в написании присутствуют также в 10 протоколах осмотров от 15, 17 и 18 ноября 2012 г., находящихся в Томах №№ 28 и 29.

Попутно замечу, что такая же картина с остальными протоколами. Протокол осмотра из Тома 28 л.д. 158-164. 17 ноября 2012 г. следователь с теми же понятыми за 1 час 10 минут (с 9:10 до 10:20) якобы отсмотрел видеозаписи суммарной длительностью 1 час 08 минут с 5 источников, вырезал и записал на отдельные диски 6 фрагментов видео (с присутствием Андрея Барабанова), сделал 11 скриншотов, сделал на них пометки, сделал макет страниц для распечатки и написал протокол на 7 страницах.

Я уверен, что данные протоколы не отражают реального времени, обстоятельств и методов проведения следователем данных следственных действий, есть серьезные основания сомневаться в присутствии на них понятых, и потому я прошу критически отнестись ко всем протоколам осмотра видео из 28-го и 29-го томов дела.

Вернемся к моей подзащитной. Обвинение утверждает, что Наумова «не менее восьми раз бросала в полицию куски асфальта». Потерпевший Сутормин утверждал в суде, что Наумова (Духанина) бросила дважды (один раз попав ему в бронежилет) и один раз облила его квасом. Потерпевший Зелянин – что «несколько раз», точнее сказать не может. И лишь предполагает, что именно Духанина попала в него самого. К тому же не считает себя потерпевшим ни от кого из подсудимых (показания в суде 1 октября). Свидетель Наумов сообщил суду, что Духанина кидала в кого-то чем-то (предположительно асфальтом), сколько раз - не помнит. И наконец, свидетель Пенезев – что Наумова (Духанина) кинула один раз, неизвестно, попав ли в кого-то. Просуммировать неизвестные величины невозможно. Свидетели и потерпевшие вполне могли наблюдать и описывать одно и то же действие Наумовой (Духаниной). Но ни следствие, ни обвинение не проявило ни малейших усилий к точному определению времени, места и обстоятельств всех эпизодов, не привело никаких криминалистических исследований действий Наумовой. Это, кстати, касается и эпизодов всех остальных подсудимых. Из материалов дела и обвинения неясно, к какому конкретно эпизоду относятся отдельные фрагменты с диска. Неизвестно, есть ли на них эпизод с Зеляниным. Но если идентифицировать эти 15 фрагментов, получается следующее (я говорю лишь об очевидных вещах, воспринимаемых невооруженным взглядом без какой-либо специальной экспертизы):

Сюжет файла «Video-9 отрезок с 00 мин. 00 сек. по 00 мин. 20 сек.» идентичен финалу сюжета файла «00073 отрезок с 00 мин. 00 сек. 01 min. 28 сек.»

Сюжет файла «346_0044_02 отрезок с 04 мин 57 сек. по 05 мин. 15 сек.» идентичен сюжету на файлах «00073 отрезок с 00 мин. 00 сек. 01 min. 28 сек.» и «trolltvru - Милая девушка кидает камни в полицию [H.264 1080p]»

Идентичны сюжеты файлов «346_0044_01 отрезок с 21 мин. 36 sec. по 21 мин. 45 сек.» и «bolotnayarh-Matrox отрезок с 09 мин. 47 sec. по 09 мин. 51 сек.»

На файлах «346_0044_02 отрезок с 00 мин. 25 сек. по 00 мин. 27 сек.», «346_0044_02 отрезок с 02 мин. 46 сек. по 02 мин. 54 сек.» и «346_0044_01 отрезок с 20 мин. 56 sec. по 20 мин. 59 сек.» длительностью 3, 4 и 8 секунд мы видим плотную толпу, в которой вообще не наблюдается человека, схожего с Наумовой (Духаниной), либо мелькает вдали нерезкий силуэт головы, чем-то ее напоминающий. Но определить ее действия в этих фрагментах просто невозможно.

Так сколько же и каких ее действий подтверждает эта нарезка следователя Гуркина? Что конкретно должны доказывать данные видеофрагменты? Где доказательства восьми бросков асфальтом? They simply are not.

Если согласиться со следствием и девушка в черном на видеозаписи действительно Александра Наумова, то каким образом все ее описанные в обвинительном заключении действия укладываются в те 9 минут, которые я отметил при оценке видео Минаева? С какой скоростью она должна была, находясь в плотной толпе, добывать где-то эти куски асфальта и бутылки, занимать выгодную позицию, целиться, бросать? Это ведь человек, а не пулеметный расчет. Обвинение никак не проясняет эти обстоятельства. Кроме того, возникает вопрос, какое отношение к ней имеет весь огромный материальный ущерб, вмененный обвинением в частности ей? Какой вообще ущерб могла нанести за 9 минут 18-летняя девушка асфальтовому покрытию огромной площади? Какое отношение к ней имеют поврежденные туалеты, если она была задержана более чем за полтора часа до того, как их кто-то опрокинул?

Это - о фактах, которые мы видим или же не видим вовсе. Но есть и другая сторона - человеческая. Известно, что дети, выросшие в детдоме, испытывают затруднение с описанием своих чувств и желаний. И одновременно они привыкли защищать себя сами, не рассчитывая на чью-то помощь. Ваша честь, вы видели, что получилось из попытки Александры дать показания. Можно счесть эту скороговорку по бумажке пренебрежением к суду. А можно - неумением публично говорить о своих чувствах, смущением. Александра не росла в детдоме. Но представим себе девочку, проведшую детство в тихой уютной стране, а затем уехавшую из материнского дома учиться на родину. У нее есть родители, но со школьных лет она живет не в родительском доме, а с родственниками или опекунами. А затем и вовсе одна. Если бы эта девочка способна была рассказать публично о том, как она оказалась зажата совершенно одна в жуткой давке и испытанном чувстве страха и одиночества. О том, как ее прижало спиной к каменному парапету и чуть не выкинуло в воду. О том шоке, который она испытала, когда на нее, зажатую в центре толпы и совершенно не представляющую, что происходит дальше, за пределами этой толпы, вдруг вывалились закованные в броню омоновцы, сокрушая людей на своем пути и хватая тех, кто просто стоял рядом с ней. О чувстве ужаса и искреннего, почти еще детского негодования творящейся несправедливостью, и в отношении ее самой в том числе. О том, как она, привыкшая защищать себя сама, пыталась найти хоть какое-то решение. Увы, все это она способна была с чувством рассказать лишь мне, потому лишь, что мне чем-то удалось вызвать ее доверие.

В психологии есть понятие «зараженности» действиями. Особенно это характерно для детей и подростков. Оказавшись в совершенно незнакомой сложной ситуации и не имея собственного опыта, они часто механически копируют чьи-то действия. Даже если они оказываются неудачными, неверными, это дает столь ценный опыт, что в следующий раз человек уже сам способен выбирать свое собственное решение. Возможно, Александра в поисках спасения и кинула что-то. Возможно, Александра в поисках спасения и кинула что-то. Возможно (а я отмечал на записи, что рядом с ней кто-то бросал бутылку еще до ее собственных действий), скопировала чье-то действие. Я думаю, что после всего, что произошло там и в последующем, у нее появился этот ценный опыт. И я уверен, что в любой ситуации эта девочка, веганка, вся общественная деятельность (а она занималась общественной деятельностью, да) заключалась в помощи детям и бездомным животным, просто не способна умышленно причинить вред живому существу. Она не такой человек. Эта девочка, за время домашнего заточения нашедшая для себя новую профессию – врача-ветеринара (мы все видели учебники по биологи и медицине, которые она не раз приносила в суд), не способна на умышленное насилие в отношении кого-либо. Об этом говорит и заключение психолога, приобщенное судом к делу. Давайте просто позволим ей пойти учиться этому, добро и польза в нашем обществе только выиграют. И еще раз повторю: 9 минут пребывания в хаосе и неразберихе, 9 минут страха и попыток как-то выбраться или защитить себя и шесть лет жизни, которые требует отнять у нее обвинение, - справедливое ли это соотношение?
