The Duma will discuss the law on objective truth

The State Duma has introduced a bill on objective truth. The legislative consolidation of this principle is insisted by the head of the Investigative Committee of Russia Alexander Bastrykin.

Today, January 30, the bill was sent to the State Duma Committee on civil, criminal, arbitration and procedural law.

According to the information agency "Politsivet" , the bill introduced by the deputy Alexander Remzkov ("United Russia") involves a serious reform of the basics of the trial in Russia. The introduction of the concept of objective truth will require an active intervention from the court in the procedure for evidence of the guilt of the defendant.

The bill introduces the following definition: "Objective truth is the correspondence of the reality of the circumstances established in the criminal case that is relevant to its resolution."

The adoption of a new law will, in particular, to restrict the presumption of innocence. “The legal fiction of the presumption of innocence, assumed in Article 14 of the Code of Criminal Procedure, suggesting the interpretation of unleasable doubts in favor of the accused, can only be applied if it is impossible to achieve objective truth in the case of objective truth and only after taking comprehensive measures to find it,” the bill said.

In addition, the bill proclaims the principle of adversariality of the parties in court, alien to Russian traditions and legal system: “It does not contribute to the establishment of truth and the model of adversariality implemented in the law. It gravitates to an alien traditional Russian criminal process of the Anglo-American doctrine, the so-called pure contest. ”

The ideologist of the principle of objective truth is considered the head of the RF IC Alexander Bastrykin. He has repeatedly stated that the UK would insist on the adoption of the relevant law.
