
The Moscow City Court rejected the appeal of the Russian branch of the international non -governmental organization Transparency International, said RAPSI. The decision to recover 50 thousand rubles in favor of the deputy of the State Duma of the unicorn Vyacheslav Lysakov in a lawsuit to protect honor and dignity is recognized as legal.
On December 9, the Tagansky court of Moscow partially satisfied Lysakov’s claim against the Russian branch of Transparency International. The court decided to recover moral compensation from the NPO in favor of Lysakov and ordered within ten days from the date the decision came into force to refute the information that the deputy that was not comprehensive.
The court also decided to refute the articles of other defendants, the Vedomosti newspapers and Forbes magazine, and pay him a monetary compensation in the amount of about 100 thousand rubles as a whole. Representatives of publications in court did not recognize the claims of the deputy, referring to the law on the media.
Lysakov demanded to refute information about his income , given in the July report of the organization "Questions to deputies - 2013". The information specified in this report was taken from the database of the Declarator project, which Transparency International is conducted together with the Civil Initiatives Committee Alexei Kudrin and the Slon.ru portal. The corresponders in the case were Vedomosti and Forbes, which published the information of the report.
United Russia also insisted that Transparency International, Vedomosti and Forbes compensate him for moral damage in equal shares. Lysakov estimates the amount of damage at 9.112 million rubles. It was this amount that was indicated in the report as an alleged total value of the property acquired by the deputy.
The report analyzed the growth of property of deputies of the State Duma and their family members in 2012 compared to 2011. Lysakov was included in the list of deputies whose expenses may be higher than family income in three years. The certificate indicated that in 2012, Uneneros purchased a Toyota Crown Majesta car with an assessment value of 2.885-3.244 million rubles, and his wife - an apartment with an area of 36.7 square meters, the cost of which is estimated at about 5.869 million rubles. At the same time, the total family income in three years amounted to only about 4.153 million rubles.
Meanwhile, Lysakov in the lawsuit noted that his car was released in 1995 and its market value is only about 200 thousand rubles. He also stated that his wife bought an apartment back in 2007, before marriage, and paid 3.372 million rubles for her. According to the deputy, this is confirmed by the technical passport of the car and the contract of sale of the apartment.
Elena Panfilova, director of the Russian Center for Transparency International, noticed in connection with the upcoming trial: “It is good that in the court claim Vyacheslav Lysakov opens up information to our center and society as a whole that allow you to clarify the value of property.” She added that in the report “Questions to deputies - 2013” there are no accusations against the unicorn - it only indicates a possible inconsistency of the expenses of the deputy to his income and it is proposed to explain this discrepancy.
At the same time, Transparency International drew attention to the fact that the information included in the study was taken from the officially published declarations. In addition, Lysakov did not appeal to the organization with a request to refute the information of the report. The organization recommended the claims put forward by a unicorn to the developers of the system of declaration of income and property of public officials. This system, noted in NPOs, provides no information for monitoring the income and expenses of deputies and officials. In particular, now it does not indicate the year of production of the purchased car, as well as the date of purchase of property and its value.
