Judge of the Leninsky District Court of St. Petersburg Irina Ezhvertina sentenced Denis Levkin to 4 years in the colony under Part 2 of Art. 318 of the Criminal Code "Application of violence in relation to a representative of the authorities." The student’s defense insisted that the young man was convicted on the basis of false testimonies of the police who pointed out the wrong person who could actually attack them. The charge indicated that Levkin deliberately caused the police bodily harm. The lawyer of the convict and his mother, speaking in court, called the name of the man who, most likely, hit the law enforcement officers with a metal rod. The results of an independent examination also confirmed that in the photo and video a person with a rod in his hands is clearly visible, dressed in a completely different way than Levkin. But the court did not take into account anything, unambiguously taking the prosecution.

The case of the capture by a group of radical youth of the empty historical building of Pakgauz No. 2 at the former Warsaw station was born in St. Petersburg almost a year ago. At the end of December 2012, on the eve of the New Year holidays, a group of left -wing activists and anarchists organized Squat in the Packgauz. However, the radical city defenders decided to capture the building after it became known that the owner of the building - Adamant LLC - was going to demolish it. Then the youth arbitrarily moved into an empty Packgaus, the news about this quickly spread through social networks and supporters of an informal culture began to gather there. They arranged something like a cultural center in an empty Packgauz-with city-pineword exhibitions, concerts, discussions. They took place, as a rule, with alcohol. The building was not heated, but this did not embarrass the "squatter" - they extended an electric cable to it from neighboring rooms and turned on the heaters. Periodically, due to stolen electricity and noisy gatherings, the anarchists had skirmishes with Chopovites, although, in principle, for almost a month and a half “the guys lived together”.

But on February 4, the patience of the owners of the building ran out, they called the police. The anarchists barricaded the doors, refused to go out, and the friends who joined them and acquaintances tried to protect them outside - young people holding hands, standing or sitting on the ground, created a living barrier on the approaches to the doors and windows. The police pulled them out, in the course of the skirmish, two of them received blows on the head and in the face of iron rods-one policeman recorded a traumatic brain injury, and the other knocked out their teeth. The riot police caused at the scene completed the operation - almost two dozen defenders of the Pakgauz were detained, and among them Denis Levkin. But soon everyone was released, except Denis.

As Levkin himself said at the trial, he accidentally turned out to be drawn into these events: on the evening of February 4, he had a date with a girl, and during the day he met his friend Daniel on the street, who told what was happening in Packgauz. Denis went to see - the time until the evening was free. He came, looked, went for champagne - champagne sprinkled with new acquaintances in the Packgauz room. Police cars drove up: young people decided not to go out and closed the doors and windows. The police broke the bars and doors and pulled out those who defended the building from the inside.

According to Levkin, when the detainees were already sitting in police cars, his hands were carefully examined by Grigory Klebanov, who was then the head of the police of the Admiralty district (now - deputy head of the regional Main Directorate of the Ministry of Internal Affairs). After the inspection, the colonel said to his subordinates: "No, this is not him!" And after some time, Levkin found out that he was charged with attacking police officers. Denis's mother, Olga Levkina, said in court: when she arrived at the 77th police department to pick up her son’s things, a policeman who passed things, said that her son was framed by his friends.

Levkin was charged under Part 2 of Art. 318 of the Criminal Code of the Russian Federation and placed in custody, the case was referred to the Leninsky District Court.

From the accusation, the only evidence of Levkin’s guilt was the testimonies of the police. Five law enforcement officers stubbornly called Denis guilty of the attack, although they were constantly confused: they said that they learned this name already during the investigation, that from their colleagues after overclocking the anarchists. On the part of the defense, the main arguments were numerous videos and photographs - on the evening of February 4, dozens of supporters of Squotter and journalists and journalists who recorded all the events literally in seconds gathered. According to the victim police officers, they received a metal rod near the window with a large bars, through which one of the besieged and struck these blows.

“That evening, probably hundreds of photos of this window were taken there,” says the lawyer of the convicted person Gleb Lavrentiev. - But not one of them in the window is visible Levkin! The Squaters had their own leaders who were negotiating with the police, and in principle Denis could not be - he came there that evening for the first time.

In the photographs presented to the court, another person is clearly visible: 42-year-old Evgeny accounts, nicknamed Flor, a well-known participant in several shares of street art, a radical artist who participated in the shares of the war group “War”. The accounts were in the Pakgauz captured by the anarchists for almost a month: he willingly gave interviews, photographed. In the photo made during the police attack, it is the accounts that are visible in the window - an unshaven young man in a fur eulo with a metal rod in his hands.

The photographer Maxim Zmeyev (his photographs among others appeared in court as evidence) captured the moment when one of the injured police officers received a blow to the head. The photograph is visible in the photo. The face of the beating is not visible, only a hand with a stick - and the image of a large white snowflake on the mittens is clearly visible. It is in such mittens that Evgeny accounts (Flor) is captured in other photographs and videos. In addition, a jacket on a man with a piece of iron in his hands is plain and dark, with a fur edge - such a jacket wore accounts. And Denis Levkin was in a very noticeable bright jacket in a white-blue-black large cage.

The defense introduced the court the results of an independent study of the expert-consulting center Sevzraxpert. Specialists made clear conclusions: “1. There is enough reason to say that the person who strikes the police officer on the presented photo documents is not Denis Mikhailovich Levkin. 2. There is enough reason to argue that the person holding an oblong object is not Levkin. 3. There are reasons with a high degree of probability to believe that the person who strikes the policeman holding an oblong object is a conditionally named person involved No. 2. This person was called the initiator of the study by Evgeny Vladimirovich Obchetov. ” He testified in the course of the investigation: he stated that he did not beat anyone, but only sprayed the police with gas from the spray can. And when the account was twice summoned as a witness, he did not appear there. For some reason he was not declared the wanted list.

The statement of the “organization of the Libertar Communists” that appeared on social networks says: “We do not know who actually traumated the police, and if we knew, we would never talk about it. Not in the principles of anarchists to hand over people to the cops, and a shame for those who do it. ” The court attached a statement to the case file, but this did not affect the decision.

“My client turned out to be between the two lights - between the stubborn testimony of the police and the false curls for the action,” said Lawaretiev’s lawyer. - All the accusation is built only on the words of the police. In my opinion, Denis’s fault has not been proven - the conclusions of experts, and the testimonies of other witnesses, and common sense and logic were powerless against the police.

Levkina’s defense will appeal to the city court of St. Petersburg.
