As expected, at the upcoming meeting, the prosecution party will complete the presentation of their evidence: now out of nine volumes of the case in the trial, eight have already been considered. After that, the presentation of the evidence will begin protection. The hearings were postponed twice: on February 5, due to the failure to appear of lawyer Mikhail Trepashkin, on the 14th-due to the failure to appear of the representative of the prosecution-the assistant Butyrsky interdistrict prosecutor Kirill Dmitriev.
The previous meeting in the case took place on January 16 . Judge Yuri Kovalevsky satisfied the petition of the Politsek’s lawyers for the admission of human rights activist Elena Sannikova to participate in the process as a public defender.
Kovalevsky rejected other petitions filed by the defense. He refused to send a request to Roskomnadzor about whether the Radical Policy Bulletin, edited by Stomakhin, was included in the Unified All -Russian Register of Media. At the sending of such a request, Trepashkin insisted: he hoped that the officially confirmed lack of publication in this registry would eliminate the most difficult accusations from the list of incriminated accusations - preparing for public justification of terrorism using the media (part 1, part 2 of Article 205.2 of the Criminal Code).
In support of his decision, Kovalevsky referred to the "reasons indicated by the prosecution." The prosecutor insisted that since in different numbers of the ballot discovered during the search in the Stomakhin’s apartment, the same name is an additional check confirming that the “radical policy” is not required by the media.
The judge also refused to exclude the results of a psychological-linguistic examination from the case file. The lawyers indicated that the study was conducted in violation of the Code of Criminal Procedure, since the defense was not able to participate in it, declaring the discharge to the experts, asking additional questions, etc. Kovalevsky nevertheless promised to consider the arguments of the lawyers at the stage of sentencing. "
Stomakhin is in custody on November 20, 2012. The trial of it began in September 2013. In total, four accusations were imposed by the Politsyk: in parts of 1 articles 205.2 (justification of terrorism), 280 (calls for extremism) and 282 (excitement of hatred or hostility) and part 1 of Article 30, part 2 of Article 205.2 of the Criminal Code (preparation for public justification of terrorism using the media). The reason for all the charges was exclusively Stomakhin's articles, published by him in 2011-2012 on the personal blog and on the Radical Libertarian opposition " Resistance ", as well as in the low-trip Bulletin " Radical Policy ". Stomakhin threatens from 7 to 10 years in a colony.
In 2006-2011, Stomakhin had already left for a five-year term under articles 280 and 282. At that time he was also convicted exclusively for his works. During the detention, Stomakhin tried to escape from the apartment through the window along the rope, but the rope broke and he received fractures of the legs and processes of two vertebrae. From the consequences of these injuries, Politzek has not yet recovered.
Meanwhile, on January 22, 2014, the State Duma deputy, Uneneros, Alexander Sidyakin, sent a request to the Moscow prosecutor Sergei Kudeneev to accept the "prosecutor’s response measures" in connection with the emergence of new publications in another Stomakhin blog .
