The hard -wide already judicial work becomes completely hard as Veriga, during the years of reform. Judges and employees of the apparatus, ensuring their activities, are always easier to live in the old fashioned way, not being distracted by the development of new paths. It is no accident that the great Russian lawyer F. N. Palevko, speaking with a speech in the defense of the Konshinsky manufactory, compared the judicial experience with “seducing their straightforwardness” by ruts “on a wide road, which is smooth and evenly going to the goal of judicial thinking” [2] .
As I have already written, judicial reform in post-Soviet Russia, which began in the “dashing 90s” with the approval of the liberal concept [3] , quickly passed the romantic stage and was driven into the bureaucratic depot by 1997. The transformations of the “judicial part” no longer contributed to the assertion of the “judicial power in the state mechanism as an independent influential force independent in their activities from the legislative and executive authorities” [4] , but the courts called the “vertical of power” more and more deeply drawn to us. The mistry known from the biblical times was played: the original people for lentils.
At the beginning of this century, conversations about judicial reform are practically stopped and concern for the development of the judicial system [5] , which is understood as the optimization of its functioning: resource support and the convenience of its highest echelons, is in the fore. After the dramatic vicissitudes of the initial stage of the reform, the movement continued “on the bent” - to the extent of understanding the officials of the presidential administration and under the influence of the self -serving interests of the judicial authorities. On this path there was an important fork related to the activities of D. N. Kozak, who achieved some changes in the norms of the status of judges, in particular - the limitations of the term of office of the chairmen of the courts and their deputies, but beneficial innovations were insufficient to return to genuine reforms, and later were nullified. It is quite appropriate to characterize the situation in the judicial system to use a well-aimed expression of the Constitutional Court of the Russian Federation, used in connection with the consideration of complaints of several fragments of rogues; It was a question in the resolution of the Constitutional Court of the “preservation of shortcomings in the field of legal proceedings” [6] .
The Government of the Russian Federation is forced to admit: “The implemented complex of state measures in the field of development of the judicial system with positive dynamics of individual indicators has not yet had a decisive positive impact on citizens' trust in justice. This is confirmed by the data obtained during public opinion polls. In particular, according to public opinion polls, only 27 percent of Russian citizens are trusted with justice bodies, while 38 percent do not trust bodies of justice ” [7] . Speaking without elaboxes, the previous federal target program has failed: the money has been mastered, and justice, as it was, is “second freshness”. So, according to Appendix 2 to the Federal Target Program “Development of the Russian Judicial System” for 2007-2012 ”“ The most important target indicators and performance indicators ”of the programs of the program served, in particular: an increase in the share of citizens who“ trust the bodies of justice ”, from 19 % in the basic 2006 to 50 % of the program, that is, in 2012; In the same period, it was planned to reduce the share of citizens “not trusting the justice authorities”, from 33 to 6 % [8] . The calculations were not justified, and it turned out that the courts did not trust 6 times more citizens than the compilers of the program would like.
The distrust of citizens in the courts creates problems for Russia not only within the country, but also in the international arena, forcing the European Court of Human Rights to recognize the proceedings in a number of instances in an ineffective means of protecting human rights. According to the legal position of the European Court, the requirement of justice of the process includes not only the obligation to comply with the guarantees of Fair Trit (honest court), but also the lack of unprofessional participants in the proceedings and the public as a whole - doubts about the justice of the consideration of the case and impartiality of the court [9] . The European court insists that justice not only to happen, but it was obvious that it has happened (justice may only be done: it must be seen to be done) [10] .
The reasons for the distrust of citizens to the judicial system in it are rooted, not by the result of the grunt of the spiteful people. The government program for 2007-2012 provided for an “increase in the execution of judicial acts from 52 to 80 percent”, promised the implementation of legal proceedings “within a reasonable time” [11] - and now there. The text of the program for 2013-2020 says: “At present, there are a number of problems related to the quality of justice, the terms of legal proceedings, the insufficient awareness of citizens about the activities of the judicial system, the unsatisfactory work of the courts, the ineffective execution of judicial acts ...” [12] for a ten -year period from 2001 to 2011, the number of appeals of judges in the qualification collegiums of judges of the constituent entities of the Russian Federation increased by 1122 % (from 19 thousand to 40.5 thousand) [13] .
In a word, the judicial system is rich, but does not change in its most significant manifestations. Nevertheless, recent years brought the judicial system of innovation and even shock. It is time to introduce readers to the main transformations in the field of justice and evaluate their fruits.
New man
We must pay tribute to the leaders of the pyramid called the "judicial system". Over the 20 years of their dominance, they instructively using the whip and gingerbread, achieved a result, which turned out to be no tough for the Bolsheviks even by the end of their 70 -year -old reign, namely, they created a new person. Gomunkulus, born in the bowels of the judicial system, is distinguished by a kind of worldview.
As the employees of the Institute of Law Problems at the European University in St. Petersburg have established, it is necessary to talk about the “striking dissimilarity” of the values that judges and our other fellow citizens are committed, “a very large distance between the Russian with higher education and the judge”. For example, friends are “very important” for 38.7 % of Russians with higher education and only 8.2 % of judges. Free time is “very important” for 31.2 % of respondents who graduated from the university and for 14.1 % of judges. ” In the first place, the judges are not ordinary human interests and addictions, but work [14] .
Sociological studies of the judicial corps record the presence of a “hardware and bureaucratic subculture in it, the growth of which is explained by the dominant method of recruiting judicial personnel-young women from the apparatus of courts. These personnel not only have advantages in a strongly bureaucratic judicial system, since they know how to compose documents and are used to high loads, but are also convenient, because they put in the first place such qualities as responsibility and discipline that do not have a specific attitude to the profession of a judge, but important for any subordinate employee of a large hierarchical organization ” [15] .
Perhaps the main means of education of the new judicial man was the codes of professional ethics. The first of them, a model of 1993, was called the Code of Honor [16] and occupied one and a half pages, now the current is not placed on 15 sheets [17] . The orientation and meaning of this document can be judged at least under paragraph 3 of his Article 2, which orders the judge to “follow the generally accepted principles of moral and ethical behavior in society” only “in cases where any issues of judicial ethics are not regulated by the Code of Judicial Ethics”. The judge is not entitled to hang the icon in the meeting room or cross the forehead (Clause 5, Article 10 of the Code); He cannot be given a legal advice to a neighbor (part 1 of article 16 of the Code). The Supreme Court of the Russian Federation prohibits citizens with “advice and legal consultations ... regarding their actions in the trial” [18] . That's right, of course, but not always, but not in our situation: people are legally illiterate, poor and qualified legal assistance to them is almost inaccessible. I recall with anxiety how I helped the unfortunate woman from whom the villains were killed for the golden ring of her son, to draw up a claim for retention from the defendants of 150 thousand rubles as a compensation for moral damage caused - but I can’t say that this violation laid to my conscience with a serious burden.

The Code of Judicial Ethics is not just a set of good wishes developed by beautiful maneuvers. This corporate act serves as the basis for the disciplinary persecution of judges and the termination of the powers of objectionable. A nail around which all the norms of the Code rotate is the word “loyalty” hidden in article 15. It is the loyalty to the judicial system, or rather, to its chiefs, that determines the fate of the judge who, on the proposal of the chairman of the court in front of the qualification collegium. And these bodies of the judicial community work without lingering hands. From 2001 to 2011, from 32.5 thousand Russian judges, 3,408 people were subjected to disciplinary sanctions, and the powers of 653 of them were ahead of schedule, and 2,755 judges received warnings; In 2012, 12 judges were dismissed with shame, in 2013 - 20 judges [19] . In other words, every tenth judge turned out to be a penaltyman.
The provisions of the Code of Judicial Ethics are extremely vague, which allows us to consider the offense of any not entirely angelic act of the judge. For example, the powers of a judge who violated the rules of the road were terminated, for which a fine of 100 rubles was provided. [20] The Code is replete with rubber formulas like: “... the judge should not carry out any activity that could question its independence and impartiality” (paragraph 3 of article 5); “The judge must ... avoid everything that could diminish the authority of the judiciary and cause damage to the reputation of the judge” (Clause 1, Article 6); "When covering judicial activity in the media, the judge must show inspiration." (Clause 3, Article 13).
It is clear that the qualification collegium interprets these provisions, as the mythical scroll did: the judge can “stretch” or “cut” to the norm. Try to understand what means "carefulness" in communication with the press! Once in Smolensk, the judge was punished for the fact that he called corruption in an interview with a correspondent among the problems of the judicial system; It turns out that it was necessary to say that bribery is characteristic not only of the courts, but to all branches of power [21] . Having shuddered from the study of the materials of the disciplinary prosecution of judges, the Constitutional Court of Russia explained to the unnecessarily retreating guardians of the authority of the courts: “bringing the judge to disciplinary liability for criticism of court decisions and behavior of his colleagues, when the application of sanctions is argued by the fact that the relevant actions received or may be announced, unacceptably, it will contradict the formulated in the formulated in the formula The law of the goals of the judicial community leads to a violation of the constitutional and international legal principles of publicity (publicity) of proceedings, to the restriction of civil rights and freedoms, not based on the law ” [22] .
“The most important thing, perhaps, is,” notes the International Commission of Lawyers, who devoted a special report to the problem of disciplinary responsibility of Russian judges, “that the example of those who have undergone. Collection and dismissal is used to “encourage others” to act in accordance with the practices and expectations of the judicial establishment, for example, as the chairman of the court or local authorities should be. The real threat of termination of authority, in the absence of clear grounds and appropriate procedure. It may prevent judges from exercising their powers independently and efficiently ” [23] . It is difficult to disagree with these conclusions.
A feature of the “new judicial man” is the extreme elasticity of conscience and moral principles, the readiness to fulfill the turn “Kru-uh!” At any time. Clause 1 of Article 6 of the Code of Judicial Ethics of 2004 [24] (as well as the same provisions of clause 5 of article 2 of the previously current Code of Honor) forbade the judge publicly, outside the framework of professional activity, and question the court order. Now "each judge has the right to freely express his opinion"; “... The judge must interact with representatives of the media ... contribute to the professional lighting in the media of the work of the court and judges ... in the case considered the case, the judge has the right to clarify the adopted judicial act in oral or written form. The judge has the right to give explanations or commentary on the decision made by him, to express an opinion on the current practice of applying substantive and/or procedural law ”(Clause 1, Article 22, Article 13 of the Code of 2012). In Moscow in 2004, the powers of the judges ceased, in particular, for “perseverance in clarifying the parties to the right to reconcile”, and now the “judge owes. To promote the reconciliation of the parties, the peaceful settlement of the dispute ”(Clause 2, Article 11 of the Code of 2012). Can morality change so quickly in a hameleon?!

In fact, the perception of the judicial community of civilized values in words has little effect on disciplinary practice. The judges who were pioneers of morality and were injured for that, it would be necessary to restore at work with an apology and honor, and such an opportunity is available in the form of a procedure for “newly discovered circumstances” - there is, but not used. They say to us that “the law has no return strength”, but the gracious law has such a property (see part 2 of article 54 of the Constitution of the Russian Federation). And then, the moral law is recorded in the hearts, and not on paper. Not noble judges violated legal regulations, but their persecutors stopped moral standards and in that he was stiff.
In the regulation of disciplinary liability of judges, three innovations have recently appeared, two of which are really important. I bring them as the importance increases.
Firstly, since 2013, the judges can be applied in the form of recovery, along with the warning and early termination of authority, also the remark “with the insignificance of the disciplinary offense” [25] .
Secondly, a disciplinary judicial presence was abolished, a body, which included a judges of the Supreme and Supreme Arbitration Court of the Russian Federation (three judges) on a shallow basis. The dismissed judge could complain in the chipboard, and the unknown threatened to appeal to the chipboard chairman of the Armed Forces or Supreme Arbitration Court of the Russian Federation, who was entitled to demand that the judge’s powers still stop, canceling the mild decision of the qualification collegium in his case. Since February 2014, the DSP power has been used by the disciplinary board of the newly created Supreme Court of the Russian Federation [26] .
Thirdly, finally, the action of Damoklov of the sword of disciplinary persecution, hanging over the judges almost for life, was limited by a reasonable term. Since 2013, “a decision on imposing a disciplinary sanction on a judge cannot be made after six months from the date of identification of a disciplinary offense ... and after two years from the date of the disciplinary offense” (clause 61 of the Law on the status of judges). This short story will make it difficult to accumulate compromising evidence on the judge and the impact on his decisions under the threat of pursuit of red tape or other misconduct, committed many years ago, perhaps due to inexperience at the beginning of the career [27] .
Total dependence on the chairmen of the courts and other authorities is combined in the position of the domestic judge with the possibility of a complete ignoring the opinion of fellow citizens. In Moscow, for example, a referee lived up to a certain point, to which about 500 complaints were filed per year [28] (not on procedural decisions to a higher instance - this is itself, but to misconduct in the Moscow city qualification collegium of judges and the chairman of the court). The fact is that, as before, complaints of citizens against judges do not entail any legal consequences. If he wants the qualification collegium of judges, the chairman of the court or the Council of Judges, the complaint will be verified; The last two mentioned subjects have the right to implement the results of the audit, turning to the first of them with the idea of bringing the judge to disciplinary liability. But a citizen himself, infringed on rights, who was contrasted and humiliated by the judge, cannot bring the case to a disciplinary proceedings at the meeting of the qualifications of the qualifications.
So, the new judicial man is carefully permissible. Russian judges were ill with independence, like children's measles, in the early 90s of the last century, and are now pleasant to the authorities in all respects.
Shock and stability
The charming fraudster of Glumov, the character of the comedy of A. N. Ostrovsky “for any sage is quite simplicity”, deduced the exact formula for the vertical of power: “The subordinate should be timid and constantly tender.” It seems that many transformations of the judicial system are dictated by this maxim.

Достаточно вспомнить приостановление деятельности Конституционного Суда России в 1994 году, а также перевод его в «столичный город с областной судьбой» в 2007-м.
Аналогичным потрясением для Верховного и Высшего Арбитражного Суда Российской Федерации обернулся февраль 2014 года, когда неожиданно было принято затратное решение о слиянии высших судов и переезде обновленного ВС РФ к холодной Неве. Понятно, высокое предначертание никак не связывалось с незадолго до того утвержденной Федеральной целевой программой развития судебной системы на период до 2020 года: там не было ни слова о перетасовке судебных звеньев и о путешествии судов навстречу А. Н. Радищеву.

Мало удовольствия перемещаться к новому месту службы с чадами и домочадцами. Однако нервозность высших судей усилилась, когда им, вроде бы пользовавшимся благом несменяемости, вдруг объявили, что для сохранения должности их еще подвергнут отбору, пропустив через сито Специальной квалификационной коллегии; для приема экзаменов у претендентов, не являвшихся судьями, была учреждена Специальная экзаменационная комиссия [29] . Уже до меня описали атмосферу, царившую в заседаниях Специальной коллегии [30] . Но, даже забыв о «роспросе» и репликах участников этого собрания, судьи надолго запомнят обстановку чрезвычайщины, и неожиданное, как снег на голову, лишение их конституционного статуса.
Собственно, жрецам высшего правосудия, попавшим в переплет, аукнулось их нежелание подать руку помощи нижестоящим коллегам, которых изгоняли из сообщества, используя похожую схему. Захотел как-то мэр Москвы именовать суды города-героя межрайонными, что, понятно, звучит красивее, чем просто «районные». Таблички перевесили, а потом спохватились: по закону-то суды бывают районными да городскими. Вывески на зданиях судов исправили, а «несменяемых» судей вывели за штат: мол, ты работал в межрайонном суде, а нынче реформа — первые три буквы в названии затерли. И переназначили в 2004 году судей в те же кресла, но не всех. А кого не взяли (то есть выгнали), тот управы в Верховном Суде не нашел и уже не ищет.
Для нижестоящих судей тоже приберегли некоторые сюрпризы. В системе арбитражных судов меняются инстанции, вводится «вторая кассация», а проверять их акты готовится Верховный Суд в лице своих свежеиспеченных Судебных коллегий по экономическим спорам и по административным делам. Но это касается лишь судей арбитражных судов; их около 4 тысяч. Зато всех без исключения судей задело изменение системы квалификационных классов, с которыми связаны большие и не очень прибавки к жалованью. Было их семь, а стало десять (от девятого до первого, и еще высший квалификационный класс), так теперь пересчитывают, не без обид и скандалов, выслугу лет и должности в новые ранги, почти как в сталинское время аттестовывали в генералы (а кого и в полковники) из комдивов да бригвоенюристов.
Нынешняя судебная система имеет мощный остов, подобный панцирю черепахи — председателей судов и их заместителей. Броня остается стабильной, поскольку обнимает и удерживает в рамках повиновения весь судейский корпус. Это не просто судьи, да и судебными деятелями их не назовешь. Они — часть номенклатуры, плоть от плоти нашей бюрократии, ее любимцы. Уже переназначен на должность председателя Верховного Суда В. М. Лебедев, занимающий это кресло с советских времен. Специально для него, вслед за председателем Конституционного Суда В. Д. Зорькиным, законодатель снял ограничения на пребывание в должности: можно не до 70 лет возглавлять свой суд, а до кончины, не два раза по шесть лет, а еще много-много раз. Разумеется, председатели областных и к ним приравненных судов вскоре воспользуются такими же благами. Судебная система отвердевает вокруг своих отобранных по признаку лояльности руководителей; происходит откат к положению, существовавшему в прошлом веке и закрепленному в законодательстве о судебной системе 1996 года [31] .
Appeal
Мощным процессуальным фактором перестройки судов общей юрисдикции должна была послужить новая система обжалования судебных приговоров и других решений, изначально известная арбитражным судам: апелляционная проверка актов, не вступивших в законную силу. Апелляционный пересмотр решений, по замыслу, происходит «в процедурах, наиболее приближенных к производству в суде первой инстанции» [32] . Это означает, например, что в апелляционной инстанции, в отличие от кассационной, дела рассматриваются не по бумагам, а в условиях непосредственного исследования доказательств, то есть с выслушиванием показаний живых людей: подсудимых, потерпевших, свидетелей, экспертов и специалистов. Апелляционная инстанция вправе вынести по делу собственное решение, улучшающее или ухудшающее положение истца, ответчика и подсудимого; апелляционный приговор заменяет собой приговор суда первой инстанции.

Апелляционное обжалование решений мирового судьи было возможно еще с начала века, но апелляции на акты прочих судов стали подаваться в 2012 году по гражданским и в 2013 году — по уголовным делам. Ознакомление с первыми итогами этих масштабных преобразований удручает. Верховный Суд добился уменьшения нагрузки на свои коллегии, убедив законодателя изменить подсудность дел. Началась цепная реакция. Верховный Суд перестал рассматривать в качестве суда первой инстанции какие бы то ни было уголовные дела. Ради облегчения апелляционной работы Верховного Суда из ведения областных и к ним приравненных судов были изъяты и переданы в районные суды дела о многих преступлениях, включая взятку. Как следствие подсудимые (в том числе женщины и несовершеннолетние [33] , обвиняемые в убийстве) потеряли право предстать перед судом присяжных, ибо за последние 20 лет так и не удалось ввести подлинно народное судопроизводство в низовых федеральных судах. Стало невозможно жаловаться на продление срока пребывания под стражей в Верховный Суд. Даже если человека держит под стражей судья областного суда, обжаловать его решение предстоит... его же коллегам из того же областного суда.
Наблюдение за современной апелляционной процедурой рассмотрения уголовных дел и отклики адвокатов и других юристов, поступающие с мест, рисуют довольно неприглядную картину: судьи освоили и урезали апелляцию, продолжая воспроизводить прежнюю «скоростную» и «бумажную» кассацию. Практически повсеместно в апелляционном процессе суд уклоняется от удовлетворения ходатайств стороны защиты, избегает допрашивать свидетелей; подсудимый обычно не доставляется в заседание, а излагает свою позицию по видеоконференцсвязи. Говорящая голова не может полноценно наблюдать за ходом процедуры, вручать судьям для приобщения к материалам дела документы.
Кардинальная смена принципов пересмотра приговоров должна была оказать благоприятное воздействие на судебную практику, сделать вторую инстанцию придирчивее, что, теоретически, не могло не отразиться на судебной статистике. Обратимся к ее данным.
За предшествовавший введению апелляции 2012 год вторая (тогда кассационная) инстанция областных судов рассмотрела 347,1 тыс. уголовных дел по жалобам и представлениям сторон (в 2011 году — 367,7 тыс. дел). Было отменено 7,7 тысячи обвинительных приговоров районных судов (в 2011 году — 13,5 тыс.) и 0,4 тыс. оправдательных приговоров (в 2011 году — 0,5 тыс.) [34] . В 2013 году вторая (уже апелляционная) инстанция тех же федеральных судов рассмотрела 306,7 тыс. уголовных дел, отменила 4 795 обвинительных приговоров (характерно, что по реабилитирующим основаниям — только 79) и 394 оправдательных приговора районных судов [35] . Эта странность, когда новые, более справедливые механизмы пересмотра приговоров, попав на нашу почву, не обеспечивают выявления большего числа судебных ошибок, позволяет говорить о фиктивно-демонстративном характере современного апелляционного производства. Остается уповать на постепенное совершенствование института апелляции в уголовном процессе и на новую генерацию судей, способных и желающих проверять и оценивать доказательства во второй инстанции.
Как видно, судебная реформа в России продолжает идти рука об руку с контрреформой, имеющей влиятельных приверженцев. Идти вниз легче и веселее, чем вверх, рутина привлекательнее новаций. Застой судебной системы неизбежен: он может растянуться на годы без вливания в нее демократически настроенных честных судебных деятелей, без самого широкого участия в правосудии представителей народа.
