Pussy Riot did not find religious hatred in Punk-Molebne
The Presidium of the Moscow City Court, who, on the proposal of the Supreme Court of Russia, was an supervisory complaint about the verdict to the Pussy Riot punk group to the Punch band, admitted that their punk-grain did not have a motive for religious hatred. The punishment, previously imposed by Nadezhda Tolokonnikova, Maria Alekhina and Ekaterina Samutsevich, considered the presidium excessive and reduced it by 1 month.
“In the Pussy Riot case, investigators and prosecutors initially had to operate on legal categories, and not talk about the act of participants in the punk group from the point of view of religion and morality,” said Nadezhda Tolokonnikova, Maria Alekhina and Ekaterina Dmitry Dinze , commenting on the decision of the Presidium of the Moscow City Court.
The judges, having examined the supervisory complaint against the verdict, agreed with the arguments of the defense that in the actions of Pussy Riot participants there was no motive for religious hatred for the Social Group of Orthodox Believers and considered the punishment previously appointed by the Khamovnichesky court, reducing it by 1 month. This decision did not suit protection.
“We hoped that they would be justified, the case will be terminated for the lack of a crime,” Dmitry Dinze explained, “because there was no social group there, which the Moscow City Court agreed with today. Accordingly, the sign of enjoying the enemy by religious some motives is automatically disappeared. And what remains? And what remains? They came to the resolution of this decision. "
From the first days of criminal prosecution of Punch band Pussy Riot, Maria Alekhina , Nadezhda Tolokonnikova and Ekaterina Samutsevich declared their innocence and illegality of criminal proceedings. They said that their action in the Cathedral of Christ the Savior cannot be called hooliganism in the sense that the Criminal Code gives this word, and therefore, if you punish, then not a term, but an administrative fine. The same position was consistently supported by the protection of the participants in the punk group. And today, during the consideration of the supervisory appeal, the lawyer Dinze drew the attention of judges to the fact that in a secular state church norms cannot be considered generally accepted, and therefore violation of these norms cannot be considered as a manifestation of disrespect for society.
The decision of the Presidium of the Moscow City Court will probably not be the last in Pussy Riot. Their complaint was registered by the European Court of Human Rights , and it is possible that it is the Strasbourg judges that will help the Russian people understand the guilt of the Punk group participants in such a criminal offense as hooliganism.
Maria Alekhina and Nadezhda Tolokonnikova did not participate in the meeting of the Presidium of the Moscow City Court-they were abroad and, judging by the photograph published in the microblog, the photographs on the eve met with US ex-standard Hillary Clinton . The details of this meeting are not yet known.
Ekaterina Samutsevich in Moscow. She participated in the consideration of the supervisory complaint about the verdict of the Khamovnichesky court and, in particular, paid attention to the fact that during the consideration of the criminal case her right to defense was violated. The conflict of Ekaterina Samutsevich is known with Mark Feigin, Violett Volkova and Nikolai Polozov - lawyers who previously represented the interests of Pussy Riot participants. Samutsevich repeatedly tried to obtain deprivation of their lawyer status, believing that it was the unskilled actions of the defense that led to the indictment.
In February 2012, five Pussy Riot participants came to the Cathedral of Christ the Savior in Moscow and, wearing the Balaklaws masks, tried to arrange the so-called punk-grain, but in less than two minutes were expelled by security. A video with personnel from the Cathedral of Christ the Savior, widespread on the Internet, caused a great resonance. The police detained only three participants in the action - Maria Alekhina, Nadezhda Tolokonnikov and Ekaterina Samutsevich, who sentenced the Khamovnican Court of Moscow on August 17, 2012 to the two years of the colony of general regime for hooliganism. On October 10 of the same year, the Moscow City Court changed Samutsevich punishment to conditional. Tolokonnikova and Alekhin were released from the colonies in December 2013 in connection with an amnesty dedicated to the 20th anniversary of the Constitution.
And now the Moscow City Court has changed all three previously sentenced punishment from 2 years to 1 year and 11 months.
