
On Thursday, April 24, in the Zamoskvoretsky District Court of Moscow (Tatarskaya St., 1), consideration will begin on the merits of the second “swamp business”. The beginning of the hearings at 14:00. The process is conducted by judge Natalia Susina.
There are four defendants in the case: 25-year-old nationalist Ilya Gushchin, 42-year-old manager Alexander Margolin, 58-year-old pensioner Elena Kokhtareva and 28-year-old activist of the anti-fascist movement Alexei Gaskarov. All four are charged with part 2 of Article 212 (participation in the riots) and part 1 of Article 318 of the Criminal Code (the application of non -hazardous violence to a government representative).
Kokhtareva is under the recognizance not to leave, the rest of the accused is in a pre -trial detention center. During the preliminary hearings held on April 14, the preventive measures to all defendants were extended until September 30.
Margolin and Gaskarov consistently deny their guilt. Gushchin initially pleaded guilty, but then he abandoned the self -cornation, announcing the deception, which was imposed by the investigation during his first interrogation. Kokhtareva fully recognized all the accusations and petitioned for the allocation of her case in a separate proceeding and consideration in a special manner, that is, without a judicial investigation and evaluating evidence.
Nevertheless, the TFR did not satisfy this request. At the preliminary hearings, the lawyer Kokhtareva Dmitry Akimov addressed a similar petition to Susina. The judge, however, rejected the petition, saying that, before making a decision on this issue, it is necessary to listen to persons considered victims of the actions of a pensioner. At the same time, it was reported that the case of Kokhtareva will be allocated into separate proceedings after the interrogation of the “victims”.
Also, at preliminary hearings, the defense of the accused sought to terminate their criminal prosecution, but was refused. There was no request to return the case for the investigation. In addition, Susin refused to exclude a number of evidence from the case, evaluated by the defense as unacceptable - we are talking, in particular, about some examinations. At the same time, she did not introduce examinations conducted by independent specialists to the case.
