On Wednesday, the State Duma immediately in the second and third reading adopted amendments to the criminal and criminal procedure codes, introducing responsibility for the rehabilitation of Nazism. What specifically is understood by the rehabilitation of Nazism, from the amendments it is incomprehensible. But they are offered to give criminal liability to five years in prison.
The main initiator of the bill itself and its accelerated adoption is the head of the Duma Committee on Security and Combating Corruption Irina Yarovaya. She believes that the rehabilitation of Nazism is “a viral attack aimed at the young generation”. And protecting the young generation, violently fought back in recent months from human rights activists and lawyers who called these amendments the next offensive on dissent.
For the first time, the bill was submitted to the Duma back in 2009, but was never considered, and the authors began to remove their surnames from the bill one by one. He was remembered in the summer of 2013, after Leonid Gozman compared the Soviet counterintelligence and the actions of the SS. And they began to prepare a new edition, which turned out to be as well as in the light of Ukrainian events, disputes around the status of Crimea and the former republics of the USSR, information war, patriotic madness and the searches of national traitors. As Sergey Zheleznyak said in January, the deputies pushed to the active work of the deputies and the poll on the rain about the blocked Leningrad, which almost cost the closing channel.
In the first reading, the bill was considered in March. On Wednesday, they considered and accepted in two readings at once - although this document was not listed on the agenda in the morning.
In the final version, the amendments are proposed to be punished for the rehabilitation of Nazism with a fine of up to 300 thousand rubles or in the amount of the convicted person for up to two years, or forced labor up to three years, or by deprivation of liberty for the same period. If the “crime” is committed using an official position or media, the punishment increases - a fine of 100 thousand to 500 thousand rubles, forced labor or a prison term of up to five years, in addition, the deprivation of the right to occupy certain positions for up to three years.
Now - the most important thing: the rehabilitation of Nazism is meant “the denial of the facts established by the verdict of the International Military Tribunal for the Court and the punishment of the main military criminals of the European countries of the axis, the approval of the crimes established by the specified sentence, as well as the spread of knowingly false information about the activities of the USSR during the Second World War, committed publicly.”
With the first part, which concerns the sentences of the International Military Tribunal, more or less clear. But the second part gives unlimited scope for interpretations and use.
“This is a law that weanes to engage in history as a science,” says historian and journalist Nikolai Svanidze. - This means that it is impossible to criticize the actions of the USSR for the period from September 1, 1939 to May 9, 1945, because this can be perceived as the spread of knowingly false information. You can not criticize the Molotov -Ribbentrop Pact, the invasion of our troops into the territory of Poland, the Finnish war, Stalin’s actions. And how else to explain to children, schoolchildren, what happened then and why are some things happen now?
The bill has another amendment, made yesterday Irina Yarova, it offers to be punished with a fine of up to 300 thousand rubles, or by obligatory work for up to 360 hours, or correctional work for a period of up to one year for “expanding the explicit disrespect for the company about the days of military glory and commemorative dates of Russia, as well as the desecration of the symbols of military glory Russia, committed publicly. "
It causes bewilderment not only among historians - the legal department of the State Duma in its conclusion indicated the inconsistency of the name of the project to the amendment of Yarova, since "the days of military glory <...> include the events that occurred in the XIII - XIX centuries and are not related to the historical period of the existence of Nazism." However, the bill was adopted, including this amendment.
“So there are teachers of history, for example, you need to be more careful when they talk about the ice battle or the Battle of Kulikovo,” Svanidze explains. - Otherwise, they can be accused of disrespect.
According to Svanidze, the law, if it is approved by the Federation Council, has two ways - either it will be executed selectively and force scientists to resort to self -censorship, or will start “processes of historians”.
