The new law on NPOs entered into force

The law on amendments to Chapter 4 of the first part of the Civil Code was officially published in the "Russian newspaper". He radically changes the legal status of non -profit organizations.

From September 1 of this year, all legal entities, including NGOs, will be divided into corporate (with the Institute of Membership) and unitary. The first will include consumer cooperatives, public organizations, associations (unions), partnerships of real estate owners, Cossack societies entered in the state register, as well as communities of indigenous peoples. To unitary - funds, institutions, autonomous NGOs, religious organizations. A closed list of organizational and legal forms of NGOs is provided.

Members of public organizations will be recognized exclusively by citizens. No other subjects, including public associations, are given the right to be part of a public organization.

If the Charter of NPOs provides for the conduct of income income, it will be necessary to have property with a market value of at least the minimum size of the authorized capital provided for the LLC. Currently, this amount is 10 thousand rubles. For NGOs created before the entry of the Law of the SV, this norm begins to operate on January 1, 2015.

In connection with the introduction of new norms, the re -registration of legal entities, including NPOs, is not required. However, the constituent documents, as well as the names, are subject to bringing into line with the new edition of the Civil Code.

On April 25, deputy Andrei Lugovoi submitted to the State Dumaa bill on additional inspections of NGOs aimed at identifying "foreign agents" among them and subsequent registration of them in this status. It is proposed to allow an unscheduled inspection of the NPO on the basis of information received by the Ministry of Justice from the authorities and municipalities, as well as the media and citizens that the organization works as an NPO that performs the functions of a “foreign agent”, but not registered in this status.

If the information is confirmed, the Ministry of Justice will register such an organization as a "foreign agent", follows from the bill. At the same time, the NPO retains the right to appeal this decision in court.

On March 27, at a meeting with members of the Council of the Council of Council, President Vladimir Putin did not exclude changes to the work of the NPO . "Here you need to weigh everything properly, think and calmly make decisions related to the improvement of the regulatory framework," he said. According to the president, one cannot allow those who are trying to protect the interests of other states in Russia. Putin urged "not to leave loopholes to those who do not protect the interests of Russian citizens, but to protect the interests of foreign states within Russia itself."
