
Judge of the Sverdlovsk District Court of Kostroma Alla Kudryashova delays the liberation of the paralyzed Vladimir Topekhin, who was sentenced to four years of general regime on charges of fraud. This was reported by an open news agency with reference to the lawyer of the convicted person Svetlana Sidorkin. At the next meeting at the request of IK-1 of the Kostroma region, the release of Topkhin Kudryashov demanded that the colony administration submit a number of documents.
These documents include certificates that IK-1 is not able to provide the necessary medical care to paralyzed, that he will not be able to receive such assistance in other colonies of Russia and that the regional department of health will not be able to provide a medical assistance to Topokhin on a contractual conditions. The representative of the prosecutor’s office insisted on the presentation of such certificates.
Topkhin’s brother, who performed at the meeting, said that in the event of the release of a disabled person, relatives were ready to ensure his maintenance, treatment and care for him. Kudryashova demanded that she present her appropriate guarantees of relatives, as well as a medical institution ready to treat Topokhin at large.
The next meeting in the case will be held on June 9.
The consideration of the petition for the release of the disabled person began on Monday . IK-1 after the arrival of Topkhin conducted his medical examination, the results of which coincided with the conclusion of the specialists of the Russian Center of Forensic Medical Expertise, who examined the prisoner at the request of Sidorkina. Both examinations found that the diagnosis of Topokhin was mentioned in paragraph 24 of the List of Diseases, the presence of which, according to the Decree of Government No. 54 of February 13, 2004, is the basis for exemption from serving the sentence.
After that, IK-1 appealed to the court with a motion to release a disabled person. Nevertheless, on Monday, Kudryashova demanded that the FSINESTS submit documents about the results of the medical examination of Topokhin in Moscow.
On January 13, at a visiting meeting in the Moscow pre-trial detention center, the Sailor Silence Judge of the Tver District Court of the capital Tatyana Neverova sentenced Topkhina to six years of general regime under Part 4 of Article 159 of the Criminal Code (fraud on an especially large scale), and also ordered him to pay 10 million rubles in the civilian claim of the victim. On February 20, the Moscow City Court, having examined the appeal of Sidorkina, reduced Topokhin to four years .
The 31-year-old Topekhin was arrested in the summer of 2013. Shortly before that, he crashed by car, having received a traumatic brain injury, as well as damage to the spine and internal organs. In the pre -trial detention center, his condition was seriously worsening. The prisoner took the lower body and hand.
On November 20, Topokhin was transferred from the "Butyrki" to the hospital "Sailor's silence." There, thanks to the care, his condition improved slightly. However, on December 4, the patient was placed in the common camera of the SIZO-1. “He lies naked at all, without nothing, under the thorny blanket,” wrote Anna Karetnikova, a member of the metropolitan ONK. “There are no panties and T -shirts on it. The toilet is a hose and a catheter. He did not wash his teeth on his own. He was wiped with a wet towel. This is generally a motionless person.”
Topkhin was taken several times for examination in the 20th city hospital, and each time the doctors did not find grounds for his release.
On December 16, 2013, Sidorkina sent a complaint about the immediate release of Topekhin from custody in connection with the threat of his life and health. In response, the Strasbourg court demanded that Russia urgently provide information about the state of health of the prisoner , the conditions for its detention, as well as the volume of medical care he received. In addition, the ECHR asked Sidorkina a detailed complaint in the Topokhin case. The lawyer prepared this document, and in Strasbourg they have already received it.
