The decision in favor of the Lopukhinsky Garden stood in the court of second instance.
The Thirteenth Arbitration Court of Appeal did not satisfy the complaint of the RBI holding structure against the decision of the first instance, which had previously also refused to challenge the actions of the KGIOP regarding Lopukhinsky Garden.
Let us recall that in March 2013, KGIOP approved the examination presented by the St. Petersburg branch of VOOPIiK (performed by Mikhail Milchik), and in August, on its basis, it approved the boundaries and issued an order - in essence, returning the historical boundaries to the Lopukhinsky Garden object, including the plot taken away for development during Valentina Matvienko. The RBI tried to challenge these actions, but failed.
Speaking at the Legislative Assembly with an annual report, Georgy Poltavchenko ranked the protection of the boundaries of the Lopukhinsky Garden (as well as the Vavilovsky Garden with a pond) among the greatest successes in the field of heritage protection.
“We are trying to support the energy of city defenders with the force of the law and make life as difficult as possible for people and companies for whom getting benefits is more important than preserving the historical appearance of St. Petersburg,” the governor said.
The struggle for Lopukhinsky Garden lasted almost eight years. Urban defenders received adequate support only after a change in leadership responsible for the previous decisions that were detrimental to the monument. And it was precisely during that period when, by the decision of the governor, KGIOP was removed from the subordination of the construction vice-governor. Since then, according to the data given in Georgy Poltavchenko’s report, 133 unscrupulous users of cultural heritage sites have been brought to trial.
Isn’t this another confirmation of the effectiveness of just such a scheme – which Georgy Sergeevich has now decided to play back for some reason?..
