The owner and director of JSC Gagarinets, Alexei Sadchikov, failed to appeal the verdict. He was found guilty of fraud on an especially large scale and sentenced to five years in a general regime colony. The company, headed by Mr. Sadchikov, was supposed to build two multi-apartment residential buildings, attracted more than 300 million rubles of funds from shareholders for these purposes, but did not complete the construction work. Currently, Gagarinets is in the last stage of bankruptcy - bankruptcy proceedings, and Samara LLC Stroy-Kom has taken on the completion of one of the houses.

The judicial panel for criminal cases of the Samara Regional Court upheld the verdict against the director of Gagarinets CJSC Alexey Sadchikov. According to the press service of the regional prosecutor's office, Mr. Sadchikov was found guilty of committing a crime under Part 4 of Art. 159 of the Criminal Code of the Russian Federation (“Fraud committed using one’s official position, on an especially large scale”). He was sentenced to five years' imprisonment in a general regime correctional colony.

The court found that from 2003 to 2011, the director and founder of Gagarinets CJSC, Alexey Sadchikov, without permitting documentation, entered into more than 300 agreements with citizens on shared participation in the construction of two apartment buildings in Samara for a total amount of over 310 million rubles. “The developer created the appearance of construction of objects, directing part of the money to carry out individual construction work, and stole the rest of the investments and spent them at his own discretion,” reports the press service of the regional prosecutor’s office.

As a result, in one of the houses (at the intersection of Volzhskaya and Koltsevaya streets), out of 11 floors promised to shareholders, only five were built. The agreements for shared participation in the construction of the second facility (Sovetskaya Armii St., 240 b) provided for the construction of a three-section multi-story building, but in fact only two sections were partially constructed.

Since 2010, construction work at the site was stopped, and in 2011, JSC Gagarinets was declared bankrupt and bankruptcy proceedings were introduced against the organization. Let us recall that an application to declare the company bankrupt was filed by one of the shareholders, Pavel Kovalev, in July 2010.

It should be noted that on April 14, the arbitration court once again granted the petition of the bankruptcy manager of Gagarinets CJSC, Tatyana Gubareva, to extend the period of bankruptcy proceedings until July 25, 2014. In addition, on April 8, the Ministry of Construction of the Samara Region, based on the results of a competition, selected a new developer for the unfinished building on the street. Soviet army. It became the Samara LLC "Stroy-Kom".

As the prosecutor's office previously noted, Mr. Sadchikov partially admitted his guilt. During the announcement of the last word, he stated that he began construction of objects without a land lease agreement and a construction permit, since “at that time there was such a practice that in fact a construction permit was issued after the completion of work.” This is exactly what Alexey Sadchikov was counting on, but subsequently he had difficulties with the registration of land plots.

At the end of February, the Oktyabrsky District Court found Alexey Sadchikov guilty and sentenced him to five years in prison in a general regime colony. Mr. Sadchikov’s defense appealed this decision, but the judicial panel for criminal cases of the Samara Regional Court left the complaint unsatisfied. According to the press service of the prosecutor's office, the district court's verdict has entered into legal force. It was not possible to contact Alexey Sadchikov’s lawyer yesterday.
