The quotation of texts on the network will regulate the court

The Ministry of Education and the Ministry of Culture did not support the proposal of the Ministry of Economic Development that anti -pirate law would only apply to complete texts. After the law comes into force, citation on the Internet will be the subject of trial.

Since August last year, an anti -pirate law has been in force in Russia for video - sites with counterfeit films and series are blocked on the complaints of copyright holders. The Ministry of Culture and State Duma deputies prepared proposals to strengthen the fight against pirates - the mechanism for combating counterfeit films proposed to extend to other types of content.

In early May, at a meeting with the First Deputy Prime Minister Igor Shuvalov, it was decided to combine these proposals into a single package of amendments. This was engaged in the working group under the Ministry of Communications, which included representatives of the Ministry of Culture, copyright holders, Internet business, and State Duma deputies.

The final text, supported by the Ministry of Communications and the Ministry of Culture, was sent to the Ministry of Economic Development. This department has prepared a number of comments for the bill. In particular, the Ministry of Economic Development believes that only the full texts of literary works should fall under anti -pirate locks, otherwise any quotes, reposts in social networks, etc. can fall under the action of anti -pirate law.

According to paragraph 1 of Art. 1274 of the Civil Code of Russia, “quoting ... works in a volume, justified purpose of citation” - without the consent of the copyright holder and without payment of remuneration, but with the obligatory indication of the name of the author of the work, is permitted.

“We believe that conflicts on this subject are the subject of proceedings in court in accordance with the Civil Code,” a source in the government added.

The Ministry of Economic Development is sure that transferring these issues to the court level is wrong. Since there are no specifics, any quote or repost can be recognized as a violation of the law, Fomichev noted.
